iI <br /> ORDINANCE NO. //4 /- VS-- <br /> AN <br /> -AN ORDINANCE providing for the vacation of a portion of Beverly Lane <br /> lying south of SR 526 and north of Casino Road. <br /> WHEREAS, the City Council of the City of Everett did by Resolution No. 2443, <br /> duly adopt and fix the 2nd day of July, 1984, at 8:30 a.m., as the date for public <br /> hearing; and <br /> WHEREAS, due and legal notice of the time and place of said hearing and <br /> determination of said resolution has been given by the City Clerk in the manner <br /> prescribed by law; and <br /> WHEREAS, at the time and place fixed for hearing, favorable statements and <br /> objections to the vacating of the herein described street were heard and discussed; and <br /> WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in the <br /> street which is vacated; and <br /> WHEREAS, the City Council finds that it would not vacate the street could it <br /> not retain an easement; and <br /> WHEREAS, it now appears to the City Council of the City of Everett that the <br /> said street resolved to be vacated should be vacated pursuant to the terms and <br /> conditions of this ordinance; <br /> NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1: That the following described rights-of-way are hereby vacated <br /> subject to the terms and conditions of this ordinance: <br /> Parcel A: <br /> All that portion of Beverly Lane dedicated within the Plat of Toslands <br /> Half Acre Garden Tracts according to the plat thereof recorded in <br /> Volume 11 of Plats, page 101, records of Snohomish County, and, lying <br /> North of the Northerly right-of-way margin of Casino Road (as it now <br /> exists) and South of the Southerly right-of-way margin of SR 526, <br /> TOGETHER WITH THAT PORTION OF LOTS 3, 31, and 32 of said plat <br /> acquired by the State of Washington "SR 526, Everett: 40th Avenue West <br /> to SR 5," for cul-de-sac purposes. <br /> LESS, that portion of the Southeast quarter of the Southeast quarter of <br /> Section 12, Township 28 North, Range 4 East, W.M., and that portion of <br /> the Southwest quarter of the Southwest quarter of Section 7, Township 28 <br /> North, Range 5 East, W.M., described as beginning at a point opposite <br /> Highway Engineer's Station (hereinafter referred to as HES) 197 + 08.70 <br /> on the SR 526 Line Survey of SR 526, Everett: 40th Ave. W. to SR 5, and <br /> 151.35 feet Southerly therefrom; Thence Southeasterly 90.69 feet to a <br /> point opposite HES 198 + 00 on said SR 526 Line Survey and 153.00 feet <br /> Southerly therefrom; Thence Southerly to a point opposite HES <br /> 198 + 03.27 on said SR 526 Line Survey and 183.06 feet Southerly <br /> therefrom; Thence Northwesterly 90.00 feet to a point opposite HES <br /> 197 + 12 on said SR 526 Line Survey and 181.42 feet Southerly therefrom; <br /> Thence Northerly to the point of beginning. <br />
