Parcel B: That portion of Lot 1, Toslands Half Acre Garden Tracts according to the plat thereof recorded in Volume 11 of Plats, page 101, records of Snohomish County, Washington, as referred to as the "VA Line as shown on sheet 8 on that certain Washington State Department of Highway plan entitled SR 526 Everett: 40th Avenue W. to SR 5," that lies North of the Northerly right-of-way margin of Casino Road as it now exists. Section 2: That the City of Everett shall nqt be responsible nor liable for storm drainage runoff resulting from existing drainage patterns as established on City rights-of-way that may currently or in the future go over, under, or across the above- described street vacation. Section 3: That this ordinance shall not become effective unless otherwise amended until the following conditions have been met in their entirety. Failure to meet all of the following conditions shall render this ordinance null and void. A. The owners of the property abutting upon the right-of-way herein described shall compensate the City of Everett in an amount equal to one-half (1/2) the current appraised value of the area herein described in Section 1. The owners shall have ninety (90) days following passage of this ordinance within which to make payment to the City in full; B. The owners of the property abutting upon the right-of-way herein described in Section 1 shall pay the City of Everett Thirty Thousand Ninety-two Dollars and 43/100 ($30,092.43). This amount shall be in addition to that described in paragraph A of this section. The purpose of this payment is to reimburse the City for expenditures previously made by the City to pay off the assessments from LID 709 for those parcels described in Section 1 herein. The owners shall have ninety (90) days following passage of this ordinance within which to make payment to the City in full; C. The State of Washington must surplus the following described property within ninety (90) days following passage of this ordinance: All that portion of Lot 1, Toslands One Half Acre Garden Tracts according to the plat thereof recorded in Volume 13 of Plats, page 19, records of Snohomish County, Washington, LESS that portion of Casino Road as it now exists, LESS that parcel described as Parcel B of Section 1 of this ordinance. ; and D. The following described parcels must be consolidated/assembled into a single ownership within ninety (90) days following passage of this ordinance: Lots 2, 3, 31 and 32, Toslands One Half Acre Garden Tracts according to the plat thereof recorded in Volume 13 of Plats, page 19, records of Snohomish County, Washington, LESS that portion conveyed to State of Washington, -2-
