. <br /> Parcel B: <br /> That portion of Lot 1, Toslands Half Acre Garden Tracts according to the <br /> plat thereof recorded in Volume 11 of Plats, page 101, records of <br /> Snohomish County, Washington, as referred to as the "VA Line as shown <br /> on sheet 8 on that certain Washington State Department of Highway plan <br /> entitled SR 526 Everett: 40th Avenue W. to SR 5," that lies North of the <br /> Northerly right-of-way margin of Casino Road as it now exists. <br /> Section 2: That the City of Everett shall nqt be responsible nor liable for <br /> storm drainage runoff resulting from existing drainage patterns as established on City <br /> rights-of-way that may currently or in the future go over, under, or across the above- <br /> described street vacation. <br /> Section 3: That this ordinance shall not become effective unless otherwise <br /> amended until the following conditions have been met in their entirety. Failure to meet <br /> all of the following conditions shall render this ordinance null and void. <br /> A. The owners of the property abutting upon the right-of-way herein <br /> described shall compensate the City of Everett in an amount equal to one-half (1/2) the <br /> current appraised value of the area herein described in Section 1. The owners shall <br /> have ninety (90) days following passage of this ordinance within which to make payment <br /> to the City in full; <br /> B. The owners of the property abutting upon the right-of-way herein <br /> described in Section 1 shall pay the City of Everett Thirty Thousand Ninety-two Dollars <br /> and 43/100 ($30,092.43). This amount shall be in addition to that described in <br /> paragraph A of this section. The purpose of this payment is to reimburse the City for <br /> expenditures previously made by the City to pay off the assessments from LID 709 for <br /> those parcels described in Section 1 herein. The owners shall have ninety (90) days <br /> following passage of this ordinance within which to make payment to the City in full; <br /> C. The State of Washington must surplus the following described property <br /> within ninety (90) days following passage of this ordinance: <br /> All that portion of Lot 1, Toslands One Half Acre Garden Tracts <br /> according to the plat thereof recorded in Volume 13 of Plats, page 19, <br /> records of Snohomish County, Washington, LESS that portion of Casino <br /> Road as it now exists, LESS that parcel described as Parcel B of Section 1 <br /> of this ordinance. <br /> ; and <br /> D. The following described parcels must be consolidated/assembled into a <br /> single ownership within ninety (90) days following passage of this ordinance: <br /> Lots 2, 3, 31 and 32, Toslands One Half Acre Garden Tracts according to <br /> the plat thereof recorded in Volume 13 of Plats, page 19, records of <br /> Snohomish County, Washington, LESS that portion conveyed to State of <br /> Washington, <br /> -2- <br />
