n • 1 ORDINANCE NO. // g�� 2 AN ORDINANCE amending Ordinance No. 1041-84 regulating the sale, 3 possession and use of fireworks within the City limits of the City of Everett. 4 5 THE CITY OF EVERETT DOES ORDAIN: 6 Section 1: Section 3 of Ordinance No. 1041-84 which reads as follows: 7 8 "Section 3: DISCHARGE OF SPECIAL FIREWORKS. No person may discharge special fireworks at any place except as authorized 9 by state license and local permit for a public display of fireworks." 10 is hereby amended to read hereafter as follows: 11 12 "Section 3: DISCHARGE OF SPECIAL FIREWORKS. No person may discharge special fireworks at any place except as authorized by 13 state license and local permit for a public display of fireworks; provided that common fireworks, firecrackers, salutes and chasers may be 14 purchased and used by religious organizations or private organizations or persons if purchased from a licensed manufacturer, importer, or 15 wholesaler for use on prescribed dates and locations, for religious or specific purposes, upon obtaining a permit therefor from the City Fire 16 Marshal." 17 Section 2: Section 5(A) of Ordinance No. 1041-84 which reads as follows: 18 "Section 5: REQUIREMENT OF A PERMIT. 19 A. A permit shall be applied for in writing to the City's Fire 20 Marshal or designee by any person desiring to: 21 1. manufacture, import, possess or sell any fireworks at wholesale or retail for any use; or 22 2. transport fireworks, except as a public carrier delivering to 23 a licensee. 24 Provided, however, only "bona fide charitable non-profit organizations" may make application for the retail sale of fireworks. 25 "Bona fide charitable or non-profit organization" means any organization duly existing under the provisions of Chapters 24.12, 24.20, 24.28 RCW, or 26 any non-profit corporation duly existing under the provisions of Chapter 24.03 for charitable, benevolent, eleemosynary, educational and 27 civic purposes only. The fact that contributions to an organization do not qualify for charitable contribution deduction purposes or that the 28 organization is not otherwise exempt from payment of federal income taxes pursuant to the Internal Revenue Code of 1954, as amended, shall 29 constitute prima facie evidence that the organization is not a bona fide charitable or non-profit organization for the purposes of this section." 30 31 is hereby amended to read hereafter as follows: 32
