n <br /> • <br /> 1 ORDINANCE NO. // g�� <br /> 2 <br /> AN ORDINANCE amending Ordinance No. 1041-84 regulating the sale, <br /> 3 possession and use of fireworks within the City limits of the City <br /> of Everett. <br /> 4 <br /> 5 <br /> THE CITY OF EVERETT DOES ORDAIN: <br /> 6 <br /> Section 1: Section 3 of Ordinance No. 1041-84 which reads as follows: <br /> 7 <br /> 8 "Section 3: DISCHARGE OF SPECIAL FIREWORKS. No <br /> person may discharge special fireworks at any place except as authorized <br /> 9 by state license and local permit for a public display of fireworks." <br /> 10 <br /> is hereby amended to read hereafter as follows: <br /> 11 <br /> 12 "Section 3: DISCHARGE OF SPECIAL FIREWORKS. No person <br /> may discharge special fireworks at any place except as authorized by <br /> 13 state license and local permit for a public display of fireworks; provided <br /> that common fireworks, firecrackers, salutes and chasers may be <br /> 14 purchased and used by religious organizations or private organizations or <br /> persons if purchased from a licensed manufacturer, importer, or <br /> 15 wholesaler for use on prescribed dates and locations, for religious or <br /> specific purposes, upon obtaining a permit therefor from the City Fire <br /> 16 Marshal." <br /> 17 <br /> Section 2: Section 5(A) of Ordinance No. 1041-84 which reads as follows: <br /> 18 <br /> "Section 5: REQUIREMENT OF A PERMIT. <br /> 19 <br /> A. A permit shall be applied for in writing to the City's Fire <br /> 20 Marshal or designee by any person desiring to: <br /> 21 1. manufacture, import, possess or sell any fireworks at <br /> wholesale or retail for any use; or <br /> 22 <br /> 2. transport fireworks, except as a public carrier delivering to <br /> 23 a licensee. <br /> 24 Provided, however, only "bona fide charitable non-profit <br /> organizations" may make application for the retail sale of fireworks. <br /> 25 "Bona fide charitable or non-profit organization" means any organization <br /> duly existing under the provisions of Chapters 24.12, 24.20, 24.28 RCW, or <br /> 26 any non-profit corporation duly existing under the provisions of <br /> Chapter 24.03 for charitable, benevolent, eleemosynary, educational and <br /> 27 civic purposes only. The fact that contributions to an organization do not <br /> qualify for charitable contribution deduction purposes or that the <br /> 28 organization is not otherwise exempt from payment of federal income <br /> taxes pursuant to the Internal Revenue Code of 1954, as amended, shall <br /> 29 constitute prima facie evidence that the organization is not a bona fide <br /> charitable or non-profit organization for the purposes of this section." <br /> 30 <br /> 31 is hereby amended to read hereafter as follows: <br /> 32 <br />
