1 "Section 5: REQUIREMENT OF A PERMIT. 2 A. A permit shall be applied for in writing to the City's Fire Marshal or designee by any person desiring to: 3 1. manufacture, import, possess or sell any fireworks at 4 wholesale or retail for any use; or 5 2. transport fireworks, except as a public carrier delivering to a licensee." 6 7 Section 3: Section 6(B) which reads as follows: 8 "Section 6: THE CITY FIRE MARSHAL'S DUTY TO 9 INVESTIGATE APPLICATIONS FOR PERMITS. 10 B. The City Council may grant or deny an application for a permit under Section 5(A). The City Council may place reasonable 11 conditions on any permit it issues." 12 is hereby deleted. 13 14 Section 4: Section 14(A) of Ordinance No. 1041-84 which reads as follows: 15 "Section 14: UNLAWFUL SALE OF FIREWORKS - PENALTY. 16 A. It is unlawful for any person to sell or transfer or agree to 17 sell or transfer any special fireworks to any person or agree to sell or transfer special fireworks to any person who is not a fireworks licensee as 18 provided for by this chapter. A violation of the section is a gross misdemeanor." 19 20 is hereby amended to read hereafter as follows: 21 "Section 14: UNLAWFUL SALE OF FIREWORKS - PENALTY. 22 23 A. It is unlawful for any person to sell or transfer or agree to sell or transfer any special fireworks to any person or agree to sell or 24 transfer special fireworks to any person who is not a fireworks licensee as provided under this Ordinance or state law. A violation of this section is 25 a gross misdemeanor." 26 Section 5: Section 18 of Ordinance No. 1041-84 which reads as follows: 27 28 "Section 18: PERMIT FEES. The original and annual renewal permit fee for any act requiring a permit shall be 29 dollars. The permit fee shall be for the period beginning January first and ending December thirty-first or for the remaining portion thereof." 30 31 is hereby amended to read hereafter as follows: 32 -2-
