• <br /> 1 City's billboard ordinance, Ordinance No. 70-70, Chapter 16.20 EMC. Provided, <br /> 2 however, this does not prohibit the issuance of sign permits for the construction, <br /> 3 erection or placement of billboards when: <br /> 4 <br /> a. The sign permit application complies with all applicable code <br /> 5 provisions, including SEPA, and such application was filed with the <br /> City prior to the effective date of this ordinance; and <br /> 6 <br /> b. The sign permit application is for a site which is not located on or <br /> 7 visible from B-3 zoned properties or from the following entryway <br /> corridors to the City: <br /> 8 <br /> 1. Pacific Avenue from the Snohomish River to West Marine <br /> 9 View Drive; <br /> 10 2. Hewitt Avenue from the Snohomish River to Terminal <br /> Avenue; <br /> 11 <br /> 3. Everett Avenue from I-5 to Federal Avenue; <br /> 12 <br /> 4. West Marine View Drive from Pacific Avenue to East <br /> 13 Marine View Drive and I-5; <br /> 14 5. North Broadway from East Marine View Drive to 41st <br /> Street. <br /> 15 <br /> 16 Section 2: That no billboard shall be constructed, erected or placed within the <br /> 17 Everett City limits unless such construction, erection or placement is done according to <br /> 18 a sign permit issued in accordance with Section 1 of this ordinance. <br /> 19 Section 3: That any violation of the provisions of this ordinance shall <br /> 20 constitute a public nuisance which the City can abate by an action in Snohomish County <br /> 21 Superior Court. <br /> 22 Section 4: That any person, firm or corporation who violates any provision of <br /> 23 this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof, <br /> 24 shall be punishable by a fine not to exceed five hundred dollars ($500) or imprisonment <br /> 25 in jail not to exceed six (6) months, or both fine and imprisonment. Each separate day <br /> 26 or any portion thereof during which any violation of this ordinance occurs or continues <br /> 27 shall be deemed to constitute a separate offense, and upon conviction thereof, shall be <br /> 28 punishable as herein provided. <br /> 29 Section 5: That this ordinance will be in effect until September 30, 1985, <br /> 30 unless extended by the Everett City Council or earlier terminated. The Mayor is hereby <br /> 31 authorized to take all steps necessary, including legal action, to enforce the provisions <br /> 32 of this ordinance. <br /> -2- <br />
