1 to person or property, the filing of such appeal shall stay the action <br /> of the Clerk, pending the decision of the Council. <br /> 2 <br /> 3. In hearing an appeal from a decision of the Clerk, the Council must <br /> 3 accord substantial weight to the decision of the Clerk and shall <br /> affirm the decision of the Clerk unless the Council finds that it <br /> 4 was clearly erroneous in view of the entire record. <br /> 5 <br /> K. Premises Regulations. <br /> 6 <br /> The Clerk shall not license any panoram premises which do not <br /> 7 conform to the following requirements, and shall revoke or suspend the <br /> license of any panoram premises, and the license of any operator thereof, <br /> 8 which do not maintain conformity with the following requirements: <br /> 9 1. The entire interior of the panoram premises shall be arranged in <br /> such a manner that the interior of every panoram station is visible <br /> 10 from the entrance to the panoram premies, and in such a manner <br /> that the entire back of any person viewing a panoram device is <br /> 11 visible when observed from the entrance to the panoram <br /> premises.The panoram station shall at no time be obscured by any <br /> 12 curtain, door or other enclosure. <br /> 13 2. The licensee shall not permit any doors to areas on the premises <br /> which are available for use by persons other than the licensee or <br /> 14 employees of the licensee to be locked during business hours. <br /> 15 3. The Licensee shall maintain illumination generally distributed in all <br /> parts of the premises available for use by the public. Such <br /> 16 illumination shall be not less than ten (10) foot candles at floor <br /> level at all times when the premises are open or when any member <br /> 17 of the public is permitted to enter and remain therein. <br /> 18 <br /> L. Proximity to Schools Restricted. <br /> 19 <br /> No panoram premises license shall be issued for, nor shall any <br /> 20 panoram device be used or operated in, any panoram premises which are <br /> located within 1,000 feet of the grounds or building of any school. <br /> 21 <br /> 22 M. Access or Use by Persons Under 18 Prohibited. <br /> 23 It is unlawful for anyone under the age of eighteen years to be in or <br /> upon any panoram premises or to use any panoram device upon any <br /> 24 panoram premises, and it is unlawful for any operator or owner of a <br /> panoram device or for any manager or other person in charge of any <br /> 25 panoram premises to permit or allow anyone under eighteen years of age <br /> to be upon such premises or to use any such device. <br /> 26 <br /> 27 N. Violation a Gross Misdemeanor. <br /> 28 Any person violating any of the provisions of this ordinance is <br /> guilty of a gross misdemeanor and upon conviction thereof, shall be <br /> 29 punishable by a fine not to exceed five thousand dollars ($5,000) or <br /> 30 imprisonment in jail not to exceed one (1) year, or both imprisonment and <br /> fine. Each separate day or any portion thereof, during which any violation <br /> 31 of any provision of this ordinance occurs or continues, shall be deemed a <br /> separate and distinct offense. <br /> 32 <br /> -5- <br />
