1 B. When a public hearing is required, the Planning Department shall <br /> prepare a recommendation for the Planning Commission or Hearing <br /> 2 Examiner by evaluating the proposal utilizing the criteria in <br /> Section 7 of this ordinance. The Planning Commission or Hearing <br /> 3 Examiner shall make its decision based on the recommendation, <br /> public comments received, the information presented by the <br /> 4 applicant, and the criteria in Section 7 of this ordinance. <br /> 5 C. The Planning Commission or Hearing Examiner recommendation <br /> shall be conveyed to City Council for its consideration at a regular <br /> 6 public meeting. <br /> 7 D. City Council shall take final action on all shoreline permits <br /> requiring a public hearing. <br /> 8 <br /> 9 be and the same is hereby amended to read as follows: <br /> 10 <br /> PUBLIC HEARING REVIEW PROCESS: <br /> 11 <br /> A. In the following cases, decisions on applications for "Shoreline <br /> 12 permits" shall not be made until one public hearing has been held: <br /> 13 1. The Planning Commission shall hold a hearing on projects <br /> exceeding twenty-five (25) acres in size, except if it is a <br /> 14 utility project listed in subsection 2; <br /> 15 2. The Hearing Examiner shall hold a hearing on projects <br /> between one (1) and twenty-five (25) acres and shoreline <br /> 16 management substantial development permits for the <br /> following utility improvements: water supply distribution <br /> 17 and storage facilities, sanitary sewage (and storm drainage <br /> when in a combined system) transmission and treatment <br /> 18 facilities, and storm water drainage systems. All other <br /> utility facilities shall be under the jurisdiction of the <br /> 19 Everett Planning Commission; <br /> 20 3. Projects involving a conditional use or variance shall have a <br /> public hearing per sections 10.A.1 and 2 of this ordinance; <br /> 21 <br /> 4. Projects which have been administratively denied by the <br /> 22 Planning Director shall have a hearing before the Hearing <br /> Examiner. <br /> 23 <br /> B. When a public hearing is required, the Planning Department shall <br /> 24 prepare a recommendation for the Planning Commission or Hearing <br /> Examiner by evaluating the proposal utilizing the criteria in <br /> 25 Section 7 of this ordinance. The Planning Commission or Hearing <br /> 26 Examiner shall take action based on the recommendation, <br /> public comments received, the information presented by the <br /> 27 applicant, and the criteria in Section 7 of this ordinance. <br /> 28 C. The Planning Commission's recommendation shall be conveyed to <br /> City Council for its consideration at a regular public meeting.
