• <br /> 1 ORDINANCE NO. f/7/-1' <br /> 2 <br /> AN ORDINANCE amending Ordinance No. 692-80 as amended by <br /> 3 Ordinance Nos. 819-81, 823-81 and 952-83 defining the duties of <br /> the Hearing Examiner and establishing appeal procedures. <br /> 4 <br /> 5 <br /> 6 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 7 Section 1: That Section 12 of Ordinance No. 692-80 as amended by Ordinance <br /> 8 Nos. 819-81, 823-81 and 952-83 which now reads as follows: <br /> 9 <br /> Section 12: DUTIES OF THE EXAMINER: <br /> 10 <br /> A. Development Actions. <br /> 11 <br /> The Examiner shall receive and examine available information including <br /> 12 environmental checklists, and impact statements, conduct public hearings, <br /> 13 prepare a record thereof, enter findings of fact and conclusions based <br /> upon those facts, and enter decisions as provided herein. <br /> 14 1. Decisions. The decisions of the Examiner shall represent the final <br /> 15 action on the application, unless appealed, as hereinbelow <br /> specified, for the following types of development action: <br /> 16 a. Temporary use permit. <br /> 17 b. Appeals of decisions made by the Responsible Official under <br /> 18 the provisions of the City's Environmental Policy Ordinance <br /> No. 582-79. <br /> 19 c. Waivers, exceptions and appeals from administrative deter- <br /> 20 minations of the City's Street and Sidewalk Codes. <br /> 21 d. Appeals from administrative determination of the City's <br /> land use regulation codes. <br /> 22 e. Deferred improvements. <br /> 23 f. Applications for any other land use regulatory permits which <br /> 24 may be required by ordinance, but excluding variances and <br /> conditional use permits except as specified in Section 12.B.2 <br /> 25 and Section 14 of this ordinance. <br /> 26 g. Subdivision and short subdivision as specified by State law <br /> and City Subdivision Ordinance. <br /> 27 h. Nonconforming use expansion permits. <br /> 28 i. Compliance with conditions imposed pursuant to any land <br /> 29 use permit or decision which has been issued by the City of <br /> Everett Land Use Hearing Examiner. <br /> 30 j. Rezones, except rezone requests exceeding 3 acres in size <br /> 31 and area-wide rezonings recommended to the City Council <br /> by the Planning Commission. <br /> 32 <br />
