• <br /> • <br /> 1 k. Preliminary plats as prescribed by the State and City <br /> subdivision laws, except for those preliminary plats <br /> 2 exceeding 75 lots in size. <br /> 3 1. Shoreline Management Substantial Development, <br /> Conditional Use or Variance Permit for projects from one to <br /> 4 five acres in size and shoreline management substantial <br /> development permits for the following utility improve- <br /> 5 ments: water supply distribution and storage facilities, <br /> sanitary sewage (and storm drainage when in a combined <br /> 6 system) transmission and treatment facilities and storm <br /> water drainage systems. All other utility facilities shall be <br /> 7 under the jurisdiction of the Everett Planning Commission. <br /> 8 m. Planned residential developments except for proposed <br /> developments exceeding 50 residential units in size. <br /> 9 <br /> n. Special property use permits. <br /> 10 <br /> o. Conditional use permits. <br /> 11 <br /> p. In situations where a planned residential development is <br /> 12 combined with a preliminary subdivision procedure, the <br /> Hearing Examiner shall have jurisdiction over the entire <br /> 13 procedure if the preliminary subdivision is 50 lots or less, or <br /> if the planned residential development is 50 units or less. <br /> 14 <br /> 2. Jurisdiction Retained by Planning Commission. Under the <br /> 15 provisions of City Ordinance 3-68 and RCW 35.63, the Planning <br /> Commission shall retain jurisdiction for all applications for <br /> 16 development not assigned to the Hearing Examiner by this <br /> Ordinance. <br /> 17 <br /> B. Decision and Conditions. <br /> 18 <br /> 1. The Examiner's decision may be to grant or deny the application, or <br /> 19 the Examiner may require of the applicant such conditions, <br /> modifications and restrictions as the Examiner finds necessary to <br /> 20 make the application compatible with its environment and carry <br /> out the objectives and goals of the Comprehensive Plan, Shoreline <br /> 21 Management Master Program, Housing Assistance Plan, other <br /> applicable plans and programs adopted by the City Council, the <br /> 22 Zoning Ordinance, the Subdivision Ordinance and other codes and <br /> ordinances of the City of Everett. Conditions, modifications and <br /> 23 restrictions which may be imposed are, but are not limited to: <br /> 24 a. Exact location and nature of development, including <br /> 25 additional building and parking area setbacks, screenings in <br /> the form of landscaped berms, landscaping, or fencing. <br /> 26 b. Measures to mitigate the adverse environmental impacts of <br /> 27 the development. <br /> 28 c. Hours of use or operation or type and intensity of activities. <br /> d. Sequence and scheduling of development. <br /> 29 <br /> 30 e. Maintenance of the development. <br /> f. Duration of use and subsequent removal of structures. <br /> 31 <br /> 32 <br /> -2- <br />
