• <br /> 1 substantial development permits for the following utility <br /> improvements: water supply distribution and storage <br /> 2 facilities, sanitary sewage (and storm drainage when in a <br /> combined system) transmission and treatment facilities and <br /> 3 storm water drainage systems. All other utility facilities <br /> shall be under the jurisdiction of the Everett Planning <br /> 4 Commission. <br /> 5 j. Planned residential developments except for proposed devel- <br /> opments exceeding 50 residential units in size. <br /> 6 <br /> k. Special property use permits. <br /> 7 <br /> 1. Conditional use permits. <br /> 8 <br /> m. In situations where a planned residential development is <br /> 9 combined with a preliminary subdivision procedure, the <br /> Hearing Examiner shall have jurisdiction over the entire <br /> 10 procedure if the preliminary subdivision is 50 lots or less, or <br /> if the planned residential development is 50 units or less. <br /> 11 <br /> 2. Recommendations. The decision of the Examiner on the following <br /> 12 matter shall constitute a recommendation to the City Council <br /> which shall have the final authority to act on such applications: <br /> 13 <br /> a. Rezones three (3) acres or less in size; <br /> 14 <br /> b. Rezones for which there is a concurrent application for a <br /> 15 development action as is set forth in Section 12(A)(1) <br /> regardless of the size of the rezone. In this case, the <br /> 16 Examiner's decision shall constitute a recommendation as to <br /> the rezone and a decision as to the concurrent application <br /> 17 for the development action. <br /> 18 The Planning Commission shall retain jurisdiction over all other <br /> rezones not listed above including all rezones (amendments) set <br /> 19 forth in EMC 19.68.010. <br /> 20 3. Jurisdiction Retained by Planning Commission. Under the provi- <br /> sions of City Ordinance No. 3-68 and RCW 35.63, the Planning <br /> 21 Commission shall retain jurisdiction for all applications for <br /> development not assigned to the Hearing Examiner by this <br /> 22 Ordinance. <br /> 23 B. Recommendation or Decision, Conditions. <br /> 24 1. The Examiner's recommendation or decision may be to grant or <br /> deny the applications, or the Examiner may recommend or require <br /> 25 of the applicant such conditions, modifications and restrictions as <br /> the Examiner finds necessary to make the application compatible <br /> 26 with its environment and carry out the objectives and goals of the <br /> Comprehensive Plan, Shoreline Management Master Program, <br /> 27 Housing Assistance Plan, other applicable plans and programs <br /> adopted by the City Council, the Zoning Ordinance, the Subdivision <br /> 28 Ordinance and other codes and ordinances of the City of Everett. <br /> Conditions, modifications and restrictions which may be imposed <br /> 29 are, but are not limited to: <br /> 30 a. Exact location and nature of development, including addi- <br /> tional building and parking area setbacks, screenings in the <br /> 31 form of landscaped berms, landscaping, or fencing. <br /> 32 b. Measures to mitigate the adverse environmental impacts of <br /> the development. <br /> -4- <br />
