1 g. Granting of easement and dedications for roads, walkways, <br /> 2 utilities or other purposes and dedication of land or other <br /> provisions for public facilities, the need for which the <br /> 3 Examiner finds would be generated in whole or in significant <br /> part by the proposed development. <br /> 4 h. Provisions which would bring the proposal into compliance <br /> with the Comprehensive Plan. <br /> 5 <br /> i. Posting of performance bonds as required to insure <br /> 6 compliance with any conditions, modifications and/or <br /> restrictions imposed on the proposal. <br /> 7 <br /> 2. For the purposes of this section, the Examiner shall have all the <br /> 8 powers of the Board of Adjustment. <br /> 9 <br /> be and the same is hereby amended to read as follows: <br /> 10 <br /> 11 Section 12: DUTIES OF THE EXAMINER: <br /> 12 A. Development Actions. <br /> 13 The Examiner shall receive and examine available information including <br /> environmental checklists and impact statements, conduct public hearings, <br /> 14 prepare a record thereof, enter findings of fact and conclusions based <br /> 15 upon those facts, and enter decisions as provided herein. <br /> 16 1. Decisions. The decisions of the Examiner shall represent the final <br /> action on the application, unless appealed, as hereinbelow <br /> 17 specified, for the following types of development action: <br /> 18 a. Appeals of decisions made by the Responsible Official under <br /> the provisions of the City's Environmental Policy ordinance, <br /> 19 unless otherwise provided in said ordinance. <br /> b. Waivers, exceptions and appeals from administrative deter- <br /> 20minations of the City's Street and Sidewalk Codes unless <br /> 21 otherwise provided in said codes. <br /> 22 c. Appeals from administrative determinations of the City's <br /> land use regulation codes. <br /> 23 d. Deferred improvements. <br /> 24 e. Applications for any other land use permit which may be <br /> 25 required by ordinance, excluding variances and conditional <br /> use permits except as specified in Section 12.B.2 and <br /> 26 Section 14 of this ordinance. <br /> 27 f. Subdivisions and short subdivisions as specified by the City's <br /> Subdivision Ordinance. <br /> 28 g. Nonconforming use expansion permits. <br /> 29 h. Compliance with conditions imposed pursuant to any land <br /> 30 use permit or decision which has been issued by the City of <br /> Everett Land Use Hearing Examiner. <br /> 31 i. Shoreline Management Substantial Development, <br /> 32 Conditional Use or Variance Permit for projects from one to <br /> twenty-five acres in size and shoreline management <br /> -3- <br />
