b. Contiguous property owners shall have ten (10) working days <br /> from the date of mailing in which to submit written <br /> comments to the Planning Department concerning the proposed <br /> binding site plan. <br /> c. Optional Notice - When a SEPA review is required, notice <br /> shall be the same as described in SEPA Ordinance. This <br /> will be used instead of a & b. <br /> 5. Preliminary Decision: <br /> The City Planning Director and City Engineer shall determine <br /> whether the requirements set forth herein have been met and based <br /> thereon, shall approve, conditionally approve, disapprove or <br /> return to the applicant for further modification. The decision - <br /> shall be in writing and shall include findings and conclusions. <br /> D. Effect of Preliminary Approval: <br /> Preliminary approval of the binding site plan by the City shall <br /> constitute authorization for the applicant to take the necessary steps <br /> to meet the conditions imposed by the City before commencing the final <br /> binding site plan review process. <br /> E. Time Limitation: <br /> The applicant must complete all conditions of preliminary approval <br /> within three years following the date of preliminary approval, after <br /> which time the preliminary approval is void. An extension may be <br /> granted by the Planning Department for one year if the applicant has <br /> attempted in good faith to complete the requirements of preliminary <br /> approval within the original time period. Provided, however, the <br /> applicant must file a written request with the Planning Department <br /> requesting the extension at least thirty (30) days prior to the <br /> expiration of the original time period. <br /> ` -5- <br />
