• <br /> 3. A subdivision application shall not be deemed "filed" until all <br /> of the application requirements of this Ordinance have been met <br /> at which time the City shall indicate by sending a letter to the <br /> applicant. <br /> 4• Limitations on Approval: <br /> Final subdivision approval must be acquired within three (3) <br /> years of preliminary approval, after which time the preliminary <br /> subdivision approval is void. An extension may be granted by the <br /> Hearing Examiner for one (1) year if the applicant has attempted <br /> in good faith to submit the final plat within the three (3) year - <br /> time period. Provided, however, the applicant must file a <br /> written request with the Hearing Examiner requesting the <br /> extension at least thirty (30) days before expiration of the <br /> three (3) year period. <br /> F. Records <br /> File of Proceedings: <br /> All records of the Hearing Examiner's decision concerning a preliminary <br /> subdivision shall be open to public inspection per the requirements of <br /> Chapter 2.92, E.M.C. , Inspection of Public Records. <br /> -11- <br />
