J/ D (p-"S(S <br /> 2 <br /> AN ORDINANCE amending the conditional use section of the zoning code, <br /> 3 Ordinance No. 198-72 (Chapter 19.60 EMC). <br /> 4 <br /> 5 WHEREAS, the City Council has adopted new zoning categories, R-3(A), B-2(B) <br /> 6 and B-2(A), which provide for certain conditional uses; and <br /> 7 WHEREAS, this action requires the amending of the conditional use section of <br /> 8 the zoning code; <br /> 9 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 10 Section 1: That Ordinance No. 198-72 (Chapter 19.60 EMC) which reads as <br /> 11 follows: <br /> 12 <br /> "A. Conditional uses. The purpose of conditional uses is to provide <br /> 13 for specific, individual uses of specific, individual properties, or <br /> portions thereof, which are compatible in certain zones. The board <br /> 14 of adjustment will determine if proposed uses are compatible and <br /> appropriate and it may make requirements and impose restrictions <br /> 15 on the land uses, including time limitations, to assure that the <br /> purposes and functions of the zones and of this section are <br /> 16 complied with. <br /> 17 B. Criteria for determining compatibility and appropriateness shall <br /> include, but in the judgment of the board of adjustment need not be <br /> 18 limited to: <br /> 19 1. The need of the neighborhood, district or city for the uses; <br /> 20 2. The adequacy of public streets, utilities, and services to <br /> accommodate the uses; <br /> 21 <br /> 3. The density, time, and rate of change of occupancy; <br /> 22 <br /> 4. The generation of pedestrian and vehicular traffic; <br /> 23 <br /> 5. The generation of noises, odors, fumes, irritants, smoke, <br /> 24 visual pollution, etc.; <br /> 25 6. The provision for off-street parking and the adequacy and <br /> 26 safety of vehicular ingress and egress; <br /> 7. The adequacy of signs and lighting for traffic and safety; <br /> 27 <br /> 8. The architectural design, the size and height, and the <br /> 28 location and arrangement of buildings, garages, and all <br /> accessory structures, facilities, and improvements; <br /> 29 <br /> 9. The planned signing program for the facility. <br /> 30 <br /> C. Lot sizes and widths, yard requirements, off-street parking <br /> 31 requirements, and signs and lighting requirements of the zones <br /> shall be complied with. <br /> 32 <br />
