1 D. Construction, remodeling, repairing and such other work or <br /> improvements to be done in preparation for occupancy must be <br /> 2 started within six months from the date of approval of the <br /> conditional use by the board of adjustment. If they are not so <br /> 3 started the approval shall automatically be terminated and the land <br /> use shall revert to those permitted under the zone. <br /> 4 <br /> E. The board of adjustment shall determine what stipulations and <br /> 5 requirements shall be imposed on the use only after a public <br /> hearing is held. <br /> 6 <br /> F. The board of adjustment shall make a finding of fact on each of the <br /> 7 nine criteria listed under this section and shall record said findings <br /> in its official minutes." <br /> 8 <br /> 9 be and the same is hereby amended to read as follows: <br /> 10 <br /> "A. Conditional uses. The purpose of 'conditional uses' is to provide <br /> 11 for specific, individual uses of specific, individual properties, or <br /> portions thereof, which are compatible in certain zones. The <br /> 12 Hearing Examiner, after review of the site plan and a public <br /> hearing, will determine if proposed uses are compatible and <br /> 13 appropriate and may make requirements and impose restrictions on <br /> the land uses including such things as time limitations, on daily <br /> 14 operation, as well as sunset provisions, to assure that the purposes <br /> and functions of the specific zone and the compatibility criteria of <br /> 15 this section are met. Notwithstanding any other provision in this <br /> code, the Hearing Examiner shall hear all applications for <br /> 16 conditional uses. <br /> 17 B. Criteria for determining compatibility and appropriateness shall <br /> include, but need not be limited to: <br /> 18 <br /> 1. The need of the neighborhood, district or city for the uses; <br /> 19 that a concentration of like facilities not occur within one <br /> thousand feet (1,000') of each other in residential zones; <br /> 20 <br /> 2. The adequacy of public streets, utilities, and services to <br /> 21 accommodate the uses; <br /> 22 3. The number of residents, hours of operation, rate of turn- <br /> over of residents/clients; <br /> 23 <br /> 4. The generation of pedestrian and vehicular traffic; <br /> 24 <br /> 5. The generation of odors, fumes, irritants, smoke, visual <br /> 25 pollution, and compliance with the City's Noise Control <br /> Code; <br /> 26 <br /> 6. The provision for off-street parking and the adequacy and <br /> 27 safety of vehicular ingress and egress; <br /> 28 7. Control of the number, size and location of signing and <br /> lighting so as not to adversely impact the character of <br /> 29 residential areas; <br /> 30 8. The architectural design, the size and height, and the <br /> location, setback, and arrangement of buildings, garages, <br /> 31 and all accessory structures, facilities, and improvements; <br /> especially as they relate to adjacent residential uses; <br /> 32 <br /> -2- <br />
