4 , <br /> 1 9. Landscaping, buffering, screening of parking, loading areas,, <br /> service areas, particularly as they relate to adjacent <br /> 2 residential areas. <br /> 3 C. In order to provide for a comprehensive site plan review and <br /> approval process, the Hearing Examiner shall have the authority to <br /> 4 approve lot sizes and widths, yard requirements, off-street parking <br /> requirements, and signs and lighting based on the needs of the <br /> 5 specific use proposed, in conjunction with the compatibility of the <br /> use relative to adjacent uses. <br /> 6 <br /> D. Construction, remodeling, repairing and such other work or <br /> 7 improvements to be done in preparation for occupancy must be <br /> started within (one year) from the date of approval of the <br /> 8 conditional use by the Hearing Examiner. If they are not so <br /> started, the conditional use approval shall automatically be <br /> 9 terminated, unless additional time is provided for in the approval. <br /> 10 E. The Hearing Examiner shall determine what stipulations and <br /> requirements shall be imposed on the use only after a public <br /> 11 hearing is held. <br /> 12 F. The Hearing Examiner shall make findings of fact and conclusions <br /> based upon the criteria listed under this section and shall record <br /> 13 said findings and conclusions in an official written decision. <br /> 14 G. The decision of the Examiner shall be final unless appealed <br /> according to the requirements of the Hearing Examiner ordinance. <br /> 15 <br /> H. The application for a conditional use permit shall be made to the <br /> 16 Planning Department on forms prepared by the department. The <br /> Planning Department shall prepare a recommendation to the <br /> 17 Examiner." <br /> 18 <br /> Section 2: If any provision of this ordinance shall be declared unconstitutional <br /> 19 <br /> or invalid by a court of competent jurisdiction, it shall be conclusively presumed that <br /> 20 <br /> this ordinance would have been enacted without the provision so held unconstitutional <br /> 21 <br /> or invalid and the remainder of this ordinance shall not be affected as a result of said <br /> 22 <br /> 23 part being held unconstitutional or invalid. <br /> 24 <br /> r <br /> 25 W LLIAM E.
