eoe • 1 ORDINANCE NO. /'() ('O -S(e/ 2 AN ORDINANCE providing for the vacation of Pine Street between 12th 3 Street and 14th Street and a portion of 13th Street from Pine Street to the alley east of Pine Street. 4 5 WHEREAS, the City Council of the City of Everett did, by resolution, duly adopt 6 and fix the 26th day of September, 1984, at 7:00 p.m., as the date for public hearing; 7 and 8 WHEREAS, due and legal notice of the time and place of said hearing and 9 determination of said resolution has been given by the City Clerk in the manner 10 prescribed by law; and 11 WHEREAS, at the time and place fixed for hearing, favorable statements and 12 objections to the vacating of the herein described street were heard and discussed; and 13 WHEREAS, RCW 35.79.030 authorizes the City to retain an easement in the 14 street which is vacated; and 15 WHEREAS, it now appears to the City Council of the City of Everett that the 16 said street resolved to be vacated should be vacated pursuant to the terms and 17 conditions of this ordinance; 18 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 19 Section 1: That the following described right-of-way: 20 Beginning at the Northwest corner of Block 231 of said Plat; thence West 21 on the North line of Block 231 projected to a point on the West line of said Plat for 80 feet; thence South on the West line of said Plat for 905 22 feet to a point of intersection with the South line of Block 258 projected; thence East 80 feet to the Southwest corner of Block 258 of said Plat; 23 thence North along the West line of Block 258 of said Plat for 425 feet to the Northwest corner of said Block 258; thence East along the North line 24 of said Block 258 for 124 feet to the Northeast corner of Lot 1, Block 258 of said Plat; thence North 55 feet to the Southeast corner of Lot 17, 25 Block 231 of said Plat; thence West along the South line of said Block 231 for 124 feet to the Southwest corner of said Block 231, said point also 26 bears South from the point of beginning; thence North along the West line of said Block 231 for 425 feet to the point of beginning. 27 28 be and the same is hereby vacated pursuant to the conditions set forth in this ordinance. 29 Section 2: That the City of Everett shall not be responsible nor liable for 30 storm drainage runoff resulting from existing drainage patterns as established on City 31 rights-of-way that may currently, or in the future, go over, under, or across the 32 above-described street vacation.
