• <br /> • <br /> 1 Section 3: That this ordinance shall not become effective until the owners of <br /> 2 the property abutting upon the street herein described have compensated the City of <br /> 3 Everett in an amount equal to one-half (1/2) the current appraised value of the area <br /> 4 herein described less the following: <br /> 5 <br /> a. an exemption in accordance with Resolution No. 1724 in the form <br /> 6 of a greenbelt as conveyed to the City by easement approved by <br /> the City Attorney, along the following described property: <br /> 7 <br /> The East 20 feet of the West 40 feet of vacated <br /> 8 Pine Street less the North 100 feet and less the <br /> South 162.5 feet of vacated Pine Street. <br /> 9 <br /> b. that portion of vacated Pine Street to be deeded to the City of <br /> 10 Everett Housing Authority; and <br /> 11 c. that portion of the Plat of Pine Terrace to be dedicated to the City <br /> 12 of Everett as right-of-way. <br /> 13 The abutting property owners shall have one hundred eighty (180) days following <br /> 14 passage of this ordinance to exercise this vacation. Unless otherwise amended by City <br /> 15 Council, this ordinance shall be null and void if the abutting property owners fail to <br /> 16 exercise this vacation within one hundred eighty (180) days following passage of this <br /> 17 ordinance. <br /> 18 Section 4: That the City of Everett hereby retains an easement to construct, <br /> 19 reconstruct, operate, maintain, repair, and replace all utilities under, over, and across <br /> 20 the following described portions of said right-of-way: <br /> 21 <br /> 22 PINE STREET EASEMENT <br /> 23 An easement of 30.00 feet in width being 10.00 feet Easterly of a <br /> centerline and 20.00 feet Westerly of a centerline for the purpose of <br /> 24 maintaining a sanitary sewer over, under, and across a portion of Pine <br /> Street, situated in the City of Everett, Snohomish County, State of <br /> 25 Washington, the centerline of said easement being described as follows: <br /> 26 Commencing at the Northeast corner of the Plat of Baker Heights, <br /> according to the plat thereof recorded in Volume 14 of Plats, at page 111, <br /> 27 records of said county; thence South 00° 00' 49" East along the East <br /> boundary of said Plat of Baker Heights for 241.56 feet to the true point of <br /> beginning; thence South 09° 31' 38" East for 237.75 feet; thence South <br /> 28 00 00' 49" East for 381.31 feet to the beginning of a curve to the left <br /> 29 whose radius center bears North 89 59' 11" East a distance of 100.00 <br /> feet; thence along the arc of said curve for 85.59 feet and consuming a <br /> 30 central angle of 49° 02' 18" to a point on the North margin of 14th Street <br /> projected, said point also being the termination of said centerline. <br /> 31 <br /> 32 <br /> -2- <br />
