• <br /> • <br /> 1 13TH STREET EASEMENT <br /> 2 An easement of 15.00 feet in width being 7.50 feet on each side of a <br /> centerline for the purpose of maintaining a storm line over, under, and <br /> 3 across a portion of 13th Street, situated in the City of Everett, Snohomish <br /> County, State of Washington, the centerline of said easement being <br /> 4 described as follows: <br /> 5 Commencing at the Southwest corner of Lot 17, Block 231 of the Plat of <br /> Everett Division "T," according to the plat thereof recorded in Volume 7 <br /> 6 of Plats, at page 30, records of said county; thence South 00° 00' 49" East <br /> along the east line of said Block 231 projected for 25.37 feet; thence <br /> 7 North 87° 10' 12" West for 40.76 feet to the true point of beginning; <br /> thence South 87° 10' 12" East for 164.91 feet to a point on the Easterly <br /> 8 projection of an alley on the East line of said Lot 17, Block 231, point also <br /> being the termination of said centerline. <br /> 9 <br /> 10 The City of Everett further retains the right to grant to public and private <br /> 11 utilities the right to construct, reconstruct, operate, maintain, repair, and replace <br /> 12 existing or proposed utility lines including, but not limited to, telephone, gas, and <br /> 13 electrical under, over, and across the property above described, together with the <br /> 14 following described parcel: <br /> 15 <br /> That portion of Pine Street lying South of, parallel with, adjacent to, and <br /> 16 contiguous with the South margin of 12th Street, more particularly <br /> described as follows: <br /> 17 <br /> Commence at the Northeast corner of Block 5, Plat of Baker Heights, <br /> 18 according to the plat thereof recorded in Volume 14 of Plats, page 111, <br /> records of Snohomish County, Washington, and the true point of beginning; <br /> 19 thence South along the East line of Block 5, Plat of Baker Heights, for a <br /> distance of 35 feet; thence East parallel with the South margin of 12th <br /> 20 Street for a distance of 10 feet; thence North parallel with the East line <br /> of Block 5, Plat of Baker Heights, for a distance of 35 feet to the South <br /> 21 margin of 12th Street; thence West along the South margin of 12th Street <br /> for a distance of 10 feet to the true point of beginning. <br /> 22 <br /> 23 The City further retains the right of access across adjacent properties for the <br /> 24 purposes described herein. <br /> 25 Section 5: That at all times all activities conducted in and around the herein <br /> 26 described easement shall be conducted so as not to interfere with, obstruct, or endanger <br /> 27 the usefulness of any improvements or other facilities now or hereafter maintained <br /> 28 upon the easement, or in any way interfere with, obstruct, or endanger the City's use of <br /> 29 the easement. <br /> 30 Section 6: Prior to any construction, work, or any other activity being <br /> 31 conducted in or on the herein described easement by anyone other than the City, <br /> 32 notification and plans for the same shall be submitted in writing to the City and no such <br /> -3- <br />
