• 1 ORDINANCE NO. /6 7/44 2 AN ORDINANCE amending Ordinance No. 537-78 adopting interim regu- 3 lations for floodplain regulations. 4 5 WHEREAS, the City Council finds that the current zoning for the Smith and 6 Spencer Island areas is entitled "Flood Fringe Zoning;"and 7 WHEREAS, the City Council finds that since the entire area is designated 8 floodplain that zoning controls are administered in conjunction with the City's Shoreline 9 Plan which for most developments requires the acquisition of a shoreline permit; and 10 WHEREAS, the City Council finds that the shoreline plan designates the Smith 11 and Spencer Island areas as urban which the City interprets as allowing a wide range of 12 industrial, commercial and agricultural activities; and 13 WHEREAS, the City Council finds that the wide range of potential uses is not 14 properly communicated by the current "Flood Fringe" zoning classification; and 15 WHEREAS, the City Council finds that the City's Planning Commission has 16 considered a zoning designation change and has tabled consideration of this change; and 17 WHEREAS, the City Council finds that the current zoning designation is 18 inappropriate and is causing problems for landowners and the citizens of Everett; and 19 WHEREAS, the City Council finds that an emergency exists and that in order to 20 provide temporary relief to this problem and to allow the City staff and Planning 21 Commission additional time to study this issue as well as necessary changes to the 22 City's Shoreline Plan, the zoning designations need be changed on an interim basis; and 23 WHEREAS, the City Council finds that proper notice has been provided to the 24 citizens of Everett and that a public hearing has been held concerning the adoption of 25 interim regulations for floodplains; 26 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: 27 Section 1: That Section 1 E of Ordinance No. 537-78 reads as follows: 28 29 E. FLOOD FRINGE OVERLAY DISTRICT 30 The requirements of this district are in addition to those contained in the basic underlying use district, except for Smith Island where the Flood 31 Fringe Zoning District controls in conjunction with the Shoreline Plan. 32 1. Permitted Uses.
