• <br /> 1 ORDINANCE NO. /6 7/44 <br /> 2 <br /> AN ORDINANCE amending Ordinance No. 537-78 adopting interim regu- <br /> 3 lations for floodplain regulations. <br /> 4 <br /> 5 WHEREAS, the City Council finds that the current zoning for the Smith and <br /> 6 Spencer Island areas is entitled "Flood Fringe Zoning;"and <br /> 7 WHEREAS, the City Council finds that since the entire area is designated <br /> 8 floodplain that zoning controls are administered in conjunction with the City's Shoreline <br /> 9 Plan which for most developments requires the acquisition of a shoreline permit; and <br /> 10 WHEREAS, the City Council finds that the shoreline plan designates the Smith <br /> 11 and Spencer Island areas as urban which the City interprets as allowing a wide range of <br /> 12 industrial, commercial and agricultural activities; and <br /> 13 WHEREAS, the City Council finds that the wide range of potential uses is not <br /> 14 properly communicated by the current "Flood Fringe" zoning classification; and <br /> 15 WHEREAS, the City Council finds that the City's Planning Commission has <br /> 16 considered a zoning designation change and has tabled consideration of this change; and <br /> 17 WHEREAS, the City Council finds that the current zoning designation is <br /> 18 inappropriate and is causing problems for landowners and the citizens of Everett; and <br /> 19 WHEREAS, the City Council finds that an emergency exists and that in order to <br /> 20 provide temporary relief to this problem and to allow the City staff and Planning <br /> 21 Commission additional time to study this issue as well as necessary changes to the <br /> 22 City's Shoreline Plan, the zoning designations need be changed on an interim basis; and <br /> 23 WHEREAS, the City Council finds that proper notice has been provided to the <br /> 24 citizens of Everett and that a public hearing has been held concerning the adoption of <br /> 25 interim regulations for floodplains; <br /> 26 NOW, THEREFORE, THE CITY OF EVERETT DOES ORDAIN: <br /> 27 Section 1: That Section 1 E of Ordinance No. 537-78 reads as follows: <br /> 28 <br /> 29 E. FLOOD FRINGE OVERLAY DISTRICT <br /> 30 The requirements of this district are in addition to those contained in the <br /> basic underlying use district, except for Smith Island where the Flood <br /> 31 Fringe Zoning District controls in conjunction with the Shoreline Plan. <br /> 32 1. Permitted Uses. <br />
