The first floor of structures shall be two (2) feet above the <br /> regulatory flood protection elevation. <br /> 7 <br /> b. The fill shall be two (2) feet above the regulatory flood <br /> 8 protection elevation for a distance of fifteen (15) feet <br /> beyond any structure in any direction. <br /> 9 <br /> c. Beyond fifteen (15) feet from any structure the fill shall be <br /> 10 no lower than one (1) foot below the regulatory flood <br /> protection elevation. <br /> 11 <br /> d. Compliance with Federal Regulations Title 24 (CFR) Section <br /> 12 1910.3. <br /> 13 3. Conditional Uses for the Commercial/Industrial and Agricultural <br /> Flood Fringe Districts. <br /> 14 <br /> The following uses and other similar uses may be permitted at an <br /> 15 elevation below the regulatory flood protection elevation, upon <br /> compliance with Section G. <br /> 16 <br /> a. Marinas, boat rentals, boat building and repair. <br /> 17 <br /> b. Railroads, streets, utility transmission lines, and pipelines. <br /> 18 <br /> c. Accessory storage yards for equipment machinery or <br /> 19 materials. <br /> 20 <br /> Section 2: That the official map shall, upon the passage of this ordinance, be <br /> 21 <br /> amended by the City Clerk, as hereinabove provided. <br /> 22 <br /> Section 3: The City Clerk is hereby instructed to file the duly certified copy <br /> 23 <br /> of this ordinance with the County Auditor of Snohomish County, Washington. <br /> 24 <br /> Section 4: That notwithstanding any provisions of the City's Zoning Code, any <br /> 25 <br /> violation of any of the provisions set forth herein is declared a public nuisance. <br /> 26 <br /> The City is hereby authorized to apply to any court of competent jurisdiction for <br /> 27 <br /> and such court, upon hearing and for cause shown, may grant a preliminary, temporary <br /> 28 <br /> or permanent injunction restraining any person, firm and/or corporation from violating <br /> 29 <br /> any of the provisions of this ordinance, and compelling compliance with the provisions <br /> 30 <br /> thereof. <br /> 31 <br /> 32 <br /> -3- <br />
