19th AVENUE SOUTHEAST STUDY AREA REZONE CONCOMITANT AGREEMENT TO REZONE ORDINANCE NO. / 6, 3 - ATL ROZELL REZONE #7-84 THIS AGREEMENT is made and entered this 29th day of August 1984, by DR. JAMES A. ROZELL, Silver Lake Veterinary, Inc. , Pension Trust, said party being hereinafter referred to as the Owner, and the City of Everett, a municipal corporation under the laws of the State of Washington, hereinafter referred to as the City; • WITNESSETH: WHEREAS, DR. JAMES A. ROZELL, Silver Lake Veterinary, Inc. , Pension Trust, is the owner of (or has an equitable interest in) a tract of real property approximately 2.1 acres in size located north of 102nd Place S.E. between Interstate 5 and 19th Ave. S.E. (SR 527) , Everett, Snohomish County, Washington, the legal description of which is attached hereto as Exhibit A and incorporated herein by this reference; and WHEREAS, such zoning and development is adjacent to the I-5 corridor and 19th Avenue S.E. and will provide for a major commercial center and high density residential uses abutting these two north/south entry corridors to the City of Everett; and WHEREAS, the public health, safety, and welfare would be best served by anticipating the impact of such development and imposing certain mutually agreed upon standards, conditions and requirements which shall be documented herein and hereafter considered to be an integral part of the zoning restrictions applicable to the property; and WHEREAS, the Owners have agreed to develop the aforementioned property per the 19th Avenue S.E. Comprehensive Plan (The Plan) , which is incorporated herein by reference in consideration of the City considering designating the property C-2 and the Owners further agree as part of said consideration that should the City zone the property C-2, to lay out, develop, and maintain the property as hereinafter set forth; 840907029 -1- VOL i86i.PAGE2 Y?5
