1 (m) Radioactive waste. <br /> 2 (n) Any matter which, in the opinion of the Mayor, might <br /> interfere with the satisfactory operation of any treatment plants or any <br /> portion of the Sewer System. <br /> 3 <br /> In the event that sewage or other matter having or exceeding the <br /> 4 above characteristics is discharged into the sewer system, in addition to <br /> other remedies, including criminal prosecution, the Public Works Director <br /> 5 shall issue a cease and desist order. Further, the Public Works Director <br /> shall investigate the circumstances of said excess pollutant discharges or <br /> 6 sewer system blockages and estimate the cost of correction and/or <br /> treatment of said discharges during the time said discharges have <br /> 7 occurred, and the cost of correction or treatment of said discharges shall <br /> 8 be added to the sewer charges of the customer discharging said sewage or <br /> other matter. Said costs shall be subject to adjustment in accordance <br /> with the Utility Billing Supervisor's procedures. <br /> 9 <br /> In the event that the Public Works Director finds that excess <br /> 10 pollutant discharges of liquids containing suspended solids in excess of 250 <br /> parts per million or matter having a five day BOD in excess of 200 parts <br /> 11 Added per million or fats, oils and grease in excess of 50 ppm. may be continued <br /> 12 without impairing proper operation of the Everett sewage system, the <br /> Public Works Director may issue an excess pollutant discharge permit and <br /> 13 establish charges therefor. Said permit shall be revocable at any time by <br /> the Public Works Director upon finding that continued discharge of <br /> sewage exceeding the above standards will impair operation of the <br /> 14 Everett sewer system at the time of sewer connection application. All <br /> 15 applicants intending to operate any industrial or manufacturing operations <br /> shall submit data concerning type of wastewater discharges and the Public <br /> 16 Works Director shall consider issuance of an excess pollutant discharge <br /> permit at that time. <br /> 17 Correction of sewer system blockages shall be charged on a time <br /> 18 and material basis. The City Council shall by resolution establish the <br /> charges for excess pollutant discharges on the basis of an annual analysis <br /> 19 of sewer collection and treatment costs. <br /> 20 Section 3: If any section, clause, sentence or phrase of this Ordinance should <br /> 21 be held invalid or unconstitutional, the invalidity or unconstitutionality shall not affect <br /> 22 the validity or constitutionality of any other section, clause, sentence or phrase. It <br /> 23 shall be conclusively presumed that this Ordinance would have been enacted without the <br /> 24 provision so held unconstitutional or invalid and the remainder of this Ordinance shall <br /> 25 not be affected as a result of said part being held unconstitutional or invalid. <br /> 26 <br /> 27 WILLIAM E.
