• <br /> 1 pursuant to RCW 70.77. The posted list shall be in a form approved by the State Fire <br /> 2 Marshal. <br /> 3 Section 3: DISCHARGE OF SPECIAL FIREWORKS. No person may dis- <br /> 4 charge special fireworks at any place except as authorized by state license and local <br /> 5 permit for a public display of fireworks. <br /> 6 Section 4: LICENSING AND PERMIT REQUIREMENTS. <br /> 7 A. No person less than eighteen years of age may apply for or receive a <br /> 8 license or permit for the sale, possession or use of fireworks. <br /> 9 B. No license or permit is required for the possession or use of common <br /> 10 fireworks lawfully purchased at retail. <br /> 11 Section 5: REQUIREMENT OF A PERMIT. <br /> 12 A. A permit shall be applied for in writing to the City's Fire Marshal or <br /> 13 designee by any person desiring to: <br /> 14 <br /> 1. manufacture, import, possess or sell any fireworks at whole- <br /> 15 sale or retail for any use; or <br /> 16 2. transport fireworks, except as a public carrier delivering to <br /> a licensee. <br /> 17 <br /> 18 Provided, however, only "bona fide charitable non-profit organizations" may <br /> 19 make application for the retail sale of fireworks. "Bona fide charitable or non-profit <br /> 20 organization" means any organization duly existing under the provisions of Chapters <br /> 21 24.12, 24.20 or 24.28 RCW, or any non-profit corporation duly existing under the <br /> 22 provisions of Chapter 24.03 RCW for charitable, benevolent, eleemosynary, educational <br /> 23 and civic purposes only. The fact that contributions to an organization do not qualify <br /> 24 for charitable contribution deduction purposes or that the organization is not otherwise <br /> 25 exempt from payment of federal income taxes pursuant to the Internal Revenue Code <br /> 26 of 1954, as amended, shall constitute prima facie evidence that the organization is not <br /> 27 a bona fide charitable or non-profit organization for the purposes of this section. <br /> 28 B. Any person desiring to put on a public display of fireworks under <br /> 29 RCW 70.77.255(1)(b) shall apply in writing to the Ciy's Fire Marshal or designee for a <br /> 30 permit. Application shall be made at least ten days in advance of the proposed display. <br /> 31 <br /> 32 <br /> -3- <br />
