• <br /> 1 Section 6: THE CITY FIRE MARSHAL'S DUTY TO INVESTIGATE APPLICA- <br /> 2 TIONS FOR PERMITS. <br /> 3 A. The City's Fire Marshal or designee upon receiving an application for a <br /> 4 permit under Section 5(A) shall investigate the application and submit a report of <br /> 5 findings and recommendation for or against the issuance of the permit, together with <br /> 6 reasons to the City Council. <br /> 7 B. The City Council may grant or deny an application for a permit under <br /> 8 Section 5(A). The City Council may place reasonable conditions on any permit it issues. <br /> 9 C. The City's Fire Marshal or designee shall investigate whether the <br /> 10 character and location of the display as proposed would be hazardous to property or <br /> 11 dangerous to any person. Based on the investigation, the Fire Marshal or designee shall <br /> 12 submit a report of findings and a recommendation for or against the issuance of the <br /> 13 permit with reasons to the City Council. The City Council may grant or deny the <br /> 14 application and may place reasonable conditions on any permit it issues. <br /> 15 Section 7: APPLICATION FOR PERMIT TO INCLUDE EVIDENCE OF A <br /> 16 BOND OR INSURANCE. <br /> 17 A. Except where a general license has been granted by the State Fire <br /> 18 Marshal, the applicant for a permit for a public display of fireworks shall include with <br /> 19 the application evidence of a bond issued by an authorized surety company. The bond <br /> 20 shall be conditioned upon the applicant's payment of all damages to persons or property <br /> 21 resulting from or caused by such public display of fireworks, or any negligence on the <br /> 22 part of the applicant or its agents, servants, employees, or subcontractors in presenta- <br /> 23 tion of the display. Instead of a bond, the applicant may include a certificate of <br /> 24 insurance evidencing the carrying of appropriate public liability insurance for the <br /> 25 benefit of the named assured, as evidence of ability to respond in damage. The City <br /> 26 Attorney shall approve the bond or insurance if it meets the requirements in this <br /> 27 section. <br /> 28 B. The amount of the surety bond or certificate of insurance to be included <br /> 29 in an application for a permit for a public display of fireworks shall not be less than <br /> 30 fifty thousand dollars and one million dollars for bodily injury liability for each person <br /> 31 and event, respectively, and not less than twenty-five thousand dollars for property <br /> 32 damage liability. <br /> -4- <br />
