1 Section 8: LAWFUL USE OF A PUBLIC DISPLAY PERMIT. If a permit for <br /> 2 the public display of fireworks is granted, the sale, possession and use of fireworks for <br /> 3 the public display is lawful for that purpose only. The permit granted is not <br /> 4 transferable. <br /> 5 Section 9: CERTIFICATE OF GENERAL LICENSE FOR A PUBLIC DISPLAY <br /> 6 OF FIREWORKS TO BE FILED WITH APPLICATION FOR LOCAL PERMIT. An <br /> 7 individual who has received a general license from the State Fire Marshal for a public <br /> 8 display of fireworks shall file a certificate from the State Fire Marshal evidencing the <br /> 9 license with any application for a local permit for the public display of fireworks. <br /> 10 Section 10: HOURS FOR SALE AND DISCHARGE OF COMMON FIRE- <br /> 11 WORKS. No common fireworks shall be sold or discharged within the City limits <br /> 12 except from twelve o'clock noon on the twenty-eighth of June to twelve o'clock noon on <br /> 13 the sixth of July of each year. No common fireworks may be sold or discharged <br /> 14 between the hours of eleven o'clock p.m. and nine o'clock a.m. <br /> 15 Section 11: PUBLIC DISPLAYS OF FIREWORKS TO BE SUPERVISED BY <br /> 16 PYROTECHNIC OPERATORS. Every public display of fireworks shall be handled or <br /> 17 supervised by a pyrotechnic operator licensed by the State Fire Marshal. <br /> 18 Section 12: STORAGE OF UNUSED FIREWORKS. <br /> 19 A. It is unlawful for any person to store fireworks of any class without a <br /> 20 permit for such storage from the City Fire Marshal or designee. A person proposing to <br /> 21 store fireworks shall apply in writing to the City Fire Marshal or designee at least ten <br /> 22 days prior to the date of the proposed storage. The City Fire Marshal or designee <br /> 23 receiving the application for a storage permit shall investigate whether the character <br /> 24 and location of the storage as proposed would constitute a hazard to property to be <br /> 25 dangerous to any person. Based on the investigation, the Fire Marshal or designee may <br /> 26 grant or deny the application. The Fire Marshal or designee may place reasonable <br /> 27 conditions on any permit granted. <br /> 28 B. It is unlawful to store unsold stocks of fireworks remaining unsold after <br /> 29 the lawful period of sale as provided in a person's permit, except in such places of <br /> 30 storage as the City's Fire Marshal or designee approves. Unsold stocks of common <br /> 31 fireworks remaining after the authorized retail sales period as provided in Section 10 <br /> 32 shall be returned on or before July 31 of the same year to the approved storage <br /> -5- <br />
