Any person whose fireworks are seized under Section 16 may within ten <br /> 2 (10) days after such seizure petition the City Fire Marshal or State Fire Marshal to <br /> 3 return the fireworks seized upon the ground that such fireworks were illegally or <br /> 4 erroneously seized. Any petition filed hereunder shall be considered by the City Fire <br /> 5 Marshal or State Fire Marshal within fifteen (15) days after filing and an oral hearing <br /> 6 granted the petitioner, if requested. Notice of the decision of the City Fire Marshal or <br /> 7 State Fire Marshal shall be served upon the petitioner. The City Fire Marshal or State <br /> 8 Fire Marshal may order the fireworks seized to be disposed of or returned to the <br /> 9 petitioner if illegally or erroneously seized. The determination of the City Fire Marshal <br /> 10 or State Fire Marshal is final unless within sixty (60) days an action is commenced in a <br /> 11 court of competent jurisdiction for the recovery of the fireworks seized by the City <br /> 12 Fire Marshal or State Fire Marshal. <br /> 13 2. If the fireworks are not returned to the petitioner or destroyed, the City <br /> 14 Fire Marshal or State Fire Marshal may sell confiscated common fireworks to <br /> 15 wholesalers licensed by the State Fire Marshal. Sale shall be by public auction after <br /> 16 publishing a notice of the date, place and time of the auction in a newspaper of general <br /> 17 circulation in Snohomish County at least three (3) days before the date of the auction. <br /> 18 Proceeds of the sale of seized fireworks shall be deposited in a general fund. Fireworks <br /> 19 that are not legal for use and possession shall be destroyed by the City Fire Marshal or <br /> 20 State Fire Marshal. <br /> 21 Section 18: PERMIT FEES. The original and annual renewal permit fee for <br /> 21 <br /> 22 any act requiring a permit shall be /9 dollars. The permit fee shall <br /> 23 be for the period beginning January first and ending December thirty-first or for the <br /> 24 remaining portion thereof. <br /> 25 Section 19: VIOLATIONS. Where a violation of this ordinance is designated <br /> 26 as a gross misdemeanor, said violation shall be punishable by a fine of not more than <br /> 27 five thousand dollars ($5,000) or not more than one (1) year in jail or both such fine and <br /> 28 imprisonment. Any other violation of this ordinance shall be a misdemeanor punishable <br /> 29 by a fine of not more than one thousand dollars ($1,000) or not more than ninety (90) <br /> 30 days in jail or both such fine and imprisonment. <br /> 31 <br /> 32 <br /> -7- <br />
