r • . 1 Section 20: PRESENT FIREWORKS ORDINANCE REPEALED. The present 2 fireworks Ordinance No. 3882 as amended by Ordinance No. 308-74 and 353-75 codified 3 in Everett Municipal Code, Chapter 16.60 is repealed in its entirety. 4 Section 21: SEVERABILITY. If any section, clause, sentence or phrase of 5 this ordinance should be held invalid or unconstitutional, the invalidity or unconstitu- 6 tionality shall not affect the validity or constitutionality of any other section, clause, 7 sentence or phrase. 8 Section 22: PURPOSE. It is expressly the purpose of this ordinance to 9 provide for and promote the health, safety and welfare of the general public, and not to 10 create or otherwise establish or designate any particular class or group of persons who 11 will or should be especially protected or benefited by the terms of this ordinance. 12 It is the specific intent of this ordinance that no provision nor any term used in 13 this ordinance is intended to impose any duty whatsoever upon the City or any of its 14 officers of employees, for whom the implementation or enforcement of this ordinance 15 shall be discretionary and not mandatory. 16 Nothing contained in this ordinance is intended to be nor shall be construed to 17 create or form the basis for any liability on the part of the City, or its officers, 18 employees or agents, for any injury or damage resulting from the failure of a per mittee 19 to comply with the provisions of this ordinance, or by reason or in consequence of any 20 inspection, notice, order, certificate, permission or approval authorized or issued or 21 done in connection with the implementation or enforcement pursuant to this ordinance, 22 or by reason of any action or inaction on the part of the City related in any manner to 23 the enforcement of this ordinance by its officers, employees or agents. 24 ie % " � . 25 WILLIAM E.
