• <br /> • <br /> • <br /> 1 ORDINANCE NO. /437- 8l <br /> 2 <br /> AN ORDINANCE amending the procedures of the Board of Adjustment <br /> 3 and amending Sections 20(A), (B), (C), (D), (F), (H), (I), (J) and (K) <br /> of Ordinance No. 3572, as amended (EMC 19.70.010, 19.70.020, <br /> 4 19.70.030, 19.70.040, 19.70.080, 19.70.090, 19.70.100 and <br /> 19.70.110), and repealing Sections 20(E) and (g) of Ordinance No. <br /> 5 3572, as amended (EMC 19.70.050, 19.70.070). <br /> 6 <br /> 7 THE CITY OF EVERETT DOES ORDAIN: <br /> 8 Section 1: Section 20(A) of Ordinance No. 3572, as amended by Ordinance <br /> 9 No. 3826 (EMC 19.70.010), which reads as follows: <br /> 10 <br /> A. Created - Membership - Term. <br /> 11 <br /> A board of adjustment is established. The board shall consist of <br /> 12 five members, all of whom shall serve without salary. The board members <br /> shall be appointed by the mayor with consent of the counsel and shall <br /> 13 consist of citizens having an understanding of the benefits of zoning to <br /> the municipality. In case any vacancy should occur in the membership of <br /> 14 the board, for any cause, the mayor shall fill such vacancy by making an <br /> appointment with the consent of the council. The members of the board <br /> 15 may be removed by the mayor, subject to the approval of the council for <br /> such causes as he shall deem sufficient, which shall be set forth in a letter <br /> 16 filed with the council. Appointments shall expire on December <br /> thirty-first. Present members of the board shall hold office for the <br /> 17 balance of their respective appointments. One additional member shall be <br /> appointed to hold office for four years from December 31, 1964, and one <br /> 18 for five years from December 31, 1964; thereafter, each member shall be <br /> appointed for a term of five years. <br /> 19 <br /> 20 is hereby amended to read thereafter as follows: <br /> 21 <br /> A. Created - Purpose - Membership - Term. <br /> 22 <br /> 23 A board of adjustment is established. The board shall hear and <br /> decide all applications for variances from the provisions or requirements <br /> 24 of this title except for those matters which the City's Land Use Examiner <br /> has jurisdiction to hear. The board shall consist of five members, all of <br /> 25 whom shall serve without salary. The board members shall be appointed <br /> by the mayor with consent of the council and shall consist of citizens <br /> 26 having an understanding of the benefits of zoning to the municipality. In <br /> case any vacancy should occur in the membership of the board, for any <br /> 27 cause, the mayor shall fill such vacancy by making an appointment with <br /> the consent of the council. The members of the board may be removed by <br /> 28 the mayor, subject to the approval of the council for such causes as he <br /> shall deem sufficient, which shall be set forth in a letter filed with the <br /> 29 council. Appointments shall expire on December thirty-first. <br /> Commencing with the expiration of the existing terms, each new appoint- <br /> ment30 shall be for a term of six years. Notwithstanding the above, the <br /> Mayor is hereby authorized to make an appointment for a term of less <br /> 31 than six years to ensure that the terms are staggered. <br /> 32 <br />
