• <br /> 1 Section 2: Section 20(B) of Ordinance No. 3572, as amended by Ordinance <br /> 2 No. 3826 (EMC 19.70.020), which reads as follows: <br /> 3 <br /> B. Appellant. <br /> 4 <br /> Any person or persons aggrieved, or any officer, official of any <br /> 5 department, board or commission of the City, jointly or severally, may be <br /> the appellant, and may take a request for a special exception to the Board <br /> 6 for relief from any provision of the zoning ordinance or any determination <br /> of the Building Inspector in the application of the provisions of the zoning <br /> 7 ordinance to the appellant's land and/or structure except that the board <br /> shall not be permitted to grant a use not allowed in the zone in which it <br /> 8 lies or to make any change of a boundary line of a zone. The appellant <br /> shall appear at the public hearing at the time and place fixed by the Board <br /> 9 in person, by agent, or by attorney. <br /> 10 <br /> is hereby amended to read thereafter as follows: <br /> 11 <br /> 12 B. Applicant. <br /> 13 Any person or persons aggrieved may be the applicant and may <br /> make a request for a variance to the Board for relief from any provision <br /> 14 or requirement of the zoning ordinance in the application of the provisions <br /> or requirements of the zoning ordinance to the applicant's land and/or <br /> 15 structure except that the Board shall not be permitted to grant a use not <br /> allowed in the zone in which it lies, or to make any change of a boundary <br /> 16 line of a zone, or to increase the dwelling unit density such as allowing a <br /> duplex on less than a 7,500 sq. ft. lot. The applicant shall appear at the <br /> 17 public hearing at the time and place fixed by the Board in person, by <br /> agent or by attorney. <br /> 18 <br /> 19 Section 3: Section 20(C) of Ordinance No. 3572, as amended by Ordinance <br /> 20 No. 3826 (EMC 19.70.030), which reads as follows: <br /> 21 <br /> C. Petition or letter supporting or opposing appeal. <br /> 22 <br /> Any person or persons aggrieved, jointly or severally, and any <br /> 23 person, officer or official of any department, board or commission of the <br /> city may support or oppose, by petition or letter, the appellant's request <br /> 24 for a special exception. The petition or letter shall specify the reasons <br /> for supporting or opposing the appellant's request, and shall contain the <br /> 25 signature and description of the land of each property owner signing the <br /> petition or letter. The petition or letter shall be submitted to the board <br /> 26 at the time designated in its rules of procedure. <br /> 27 <br /> is hereby amended to read thereafter as follows: <br /> 28 <br /> 29 C. Petition or letter supporting or opposing variance. <br /> 30 Any person or persons, jointly or severally, may support or oppose, <br /> by petition or letter, the applicant's request for a variance.
