1 H. Time Decision Effective - Appeal. 2 1. Granting of a Variance. 3 The decision of the Board granting a variance shall become effective as of the date set forth in the Board's written order. If a 4 building permit and/or occupancy permit is not obtained by the applicant within one year from the effective date of the Board's 5 written order, the Board's decision shall cease to be effective. 6 2. Extension of a Variance. 7 The Planning Director or designee is authorized to grant a six month extension to a variance which has been granted provided a 8 written request is submitted in writing to the Planning Director prior to the expiration of the one year period and the Planning 9 Director or designee finds that the applicant has made a good faith effort to obtain a building permit and/or occupancy permit within 10 the one year time frame. The decision of the Planning Director or designee shall be final, subject to review by the Board, provided a 11 written request must be made with the Board within ten (10) days of the date of the decision by the Planning Director or designee. 12 3. Denial of a Variance. 13 The decision of the Board denying a variance shall become 14 effective as of the date set forth in the Board's written order. No person shall be permitted to make application for a variance within 15 one year following the effective date of the Board's written order denying a variance. 16 4. Appeal Period. 17 The action of the Board in granting or denying a variance shall be 18 final and conclusive, unless within fifteen (15) days from the effective date of the Board's written order an aggrieved person or 19 persons obtains a writ of certiorari from the Superior Court of Washington for Snohomish County, for purpose of review of the 20 action taken. 21 Section 8: Section 20(I) of Ordinance No. 3572 (EMC 19.70.090) which reads as 22 follows: 23 24 I. Meetings. 25 Meetings of the Board shall be held at least one each month, and at 26 such other time as the Chairman of the Board may determine. There shall be a fixed place of meetings, and all regular Board meetings shall be open 27 to the public. Notice of all public hearings before the Board shall be given by publication in the City official newspaper at least 7 days prior to 28 the date set for the hearing. The Board shall adopt its own rules of procedure and keep a record of its proceedings, findings, and action in 29 each case, and the vote of each member on each question considered in the proceedings. The presence of two members shall be necessary to 30 constitute a quorum. 31 is hereby amended to read thereafter as follows: 32 -4-
