1 H. Time Decision Effective - Appeal. <br /> 2 1. Granting of a Variance. <br /> 3 The decision of the Board granting a variance shall become <br /> effective as of the date set forth in the Board's written order. If a <br /> 4 building permit and/or occupancy permit is not obtained by the <br /> applicant within one year from the effective date of the Board's <br /> 5 written order, the Board's decision shall cease to be effective. <br /> 6 2. Extension of a Variance. <br /> 7 The Planning Director or designee is authorized to grant a six <br /> month extension to a variance which has been granted provided a <br /> 8 written request is submitted in writing to the Planning Director <br /> prior to the expiration of the one year period and the Planning <br /> 9 Director or designee finds that the applicant has made a good faith <br /> effort to obtain a building permit and/or occupancy permit within <br /> 10 the one year time frame. The decision of the Planning Director or <br /> designee shall be final, subject to review by the Board, provided a <br /> 11 written request must be made with the Board within ten (10) days <br /> of the date of the decision by the Planning Director or designee. <br /> 12 <br /> 3. Denial of a Variance. <br /> 13 <br /> The decision of the Board denying a variance shall become <br /> 14 effective as of the date set forth in the Board's written order. No <br /> person shall be permitted to make application for a variance within <br /> 15 one year following the effective date of the Board's written order <br /> denying a variance. <br /> 16 <br /> 4. Appeal Period. <br /> 17 <br /> The action of the Board in granting or denying a variance shall be <br /> 18 final and conclusive, unless within fifteen (15) days from the <br /> effective date of the Board's written order an aggrieved person or <br /> 19 persons obtains a writ of certiorari from the Superior Court of <br /> Washington for Snohomish County, for purpose of review of the <br /> 20 action taken. <br /> 21 <br /> Section 8: Section 20(I) of Ordinance No. 3572 (EMC 19.70.090) which reads as <br /> 22 <br /> follows: <br /> 23 <br /> 24 I. Meetings. <br /> 25 Meetings of the Board shall be held at least one each month, and at <br /> 26 such other time as the Chairman of the Board may determine. There shall <br /> be a fixed place of meetings, and all regular Board meetings shall be open <br /> 27 to the public. Notice of all public hearings before the Board shall be <br /> given by publication in the City official newspaper at least 7 days prior to <br /> 28 the date set for the hearing. The Board shall adopt its own rules of <br /> procedure and keep a record of its proceedings, findings, and action in <br /> 29 each case, and the vote of each member on each question considered in <br /> the proceedings. The presence of two members shall be necessary to <br /> 30 constitute a quorum. <br /> 31 is hereby amended to read thereafter as follows: <br /> 32 <br /> -4- <br />
