• <br /> 1 I. Meetings. <br /> 2 Meetings of the Board shall be held at such times as the Chairman <br /> of the Board may determine, or upon request of the City Administration. <br /> 3 There shall be a fixed place of meetings, and all regular Board meetings <br /> shall be open to the public. Notice of all public hearings before the Board <br /> 4 shall be given by publication in the City official newspaper at least seven <br /> (7) calendar days prior to the date set for the hearing. The Board shall <br /> 5 adopt its own rules of procedure and keep a record of its proceedings, <br /> findings, and action in each case, and the vote of each member on each <br /> 6 question considered in the proceedings. The presence of three members <br /> shall be necessary to constitute a quorum. <br /> 7 <br /> 8 Section 9: Section 20(J) of Ordinance No. 3572, as amended by Ordinance <br /> 9 No. 3826 (EMC 19.70.100), which reads as follows: <br /> 10 <br /> J. Procedure. <br /> 11 <br /> Applications for request for special exceptions for special property <br /> 12 uses, and variances from the ruling of the Building Inspector concerning <br /> the provisions herein contained, may be made to the Board within such <br /> 13 time as shall be prescribed by the Board. The City Clerk shall be the <br /> Secretary of the Board and shall receive all applications for requests for <br /> 14 special exceptions, requesting review of the Building Inspector's interpre- <br /> tations of the provisions of the zoning ordinance and any orders, require- <br /> 15 ments, decisions, or determinations relating thereto for a variance; and <br /> shall maintain and be custodian of all records of the minutes of the <br /> 16 meetings and findings of the Board. All records shall be open to the <br /> public. Copies of the appellant's notice of request for all special <br /> 17 exceptions shall be filed with the building Inspector, Planning <br /> Commission, and the Board, containing the decision of the Building <br /> 18 Inspector and the reasons why the appellant is aggrieved, specifying the <br /> grounds therefor; and with each application of request for a special <br /> 19 exception filed with the City Clerk there shall be paid a fee of $15.00 to <br /> cover the city's cost of handling said request for a special exception. <br /> 20 Upon the filing of such an application, the Building Inspector shall <br /> forthwith transmit to the Board all papers constituting the record and <br /> 21 decision of the Building Inspector relating to the request for a special <br /> exception. <br /> 22 <br /> The Board shall concur by a two-thirds vote, either reversing or <br /> 23 affirming the decision or determination of the Building Inspector. The <br /> Board shall fix a reasonable time for the hearing of the request for a <br /> 24 special exception, give due notice thereof to the parties and the general <br /> public, and decide the same within a reasonable time after the hearing. <br /> 25 The final disposition by the Board of any request for special exception <br /> shall be in the form of an order. <br /> 26 <br /> 27 is hereby amended to read thereafter as follows: <br /> 28 <br /> J. Procedure. <br /> 29 <br /> Applications for request for variances may be made to the Board <br /> 30 within such time as shall be prescribed by the Board. The City shall <br /> provide a Secretary of the Board who shall receive all applications for <br /> 31 requests for a variance; and shall maintain and be custodian of all records <br /> 32 <br /> -5- <br />
