1 of the minutes of the meetings and findings of the Board. With each <br /> 2 application for a variance filed with the designated City Official there <br /> shall be paid a fee in the amount set forth in the City's fee ordinance, <br /> 3 Ordinance No. 701-80 (as it is or is hereafter amended) to cover the City's <br /> cost of handling said request for a variance. Upon the filing of such an <br /> 4 application, the Secretary shall forthwith transmit to the Board all papers <br /> constituting the record relating to the request for a variance at least one <br /> 5 week prior to the hearing date. <br /> 6 The Board shall concur by a majority vote of those members <br /> present and constituting a quorum, either supporting or denying the <br /> 7 application for a variance. The final disposition by the Board of any <br /> request for a variance shall be in the form of an order which shall be <br /> 8 forwarded to the applicant, the Public Works Department and the Building <br /> Department. <br /> 9 <br /> 10 Section 10: Section 20(K) of Ordinance No. 3572, as amended by Ordinance <br /> 11 No. 3826 (EMC 19.70.110), which reads as follows: <br /> 12 K. Stay. <br /> 13 A request for any special exception (i.e., review and variance) to <br /> 14 the Board stays all proceedings, in furtherance of the action from which <br /> the request for a special exception was taken, unless the Building <br /> 15 Inspector from whom the request for a special exception is taken, <br /> certifies to the Board, after the notice of a request for a special <br /> 16 exception shall have been filed with him, that by reason of facts stated in <br /> the certification, a stay would, in his opinion, cause imminent peril to life <br /> or property, in which case such action shall not be stayed otherwise than <br /> 17 by a restraining order which may be issued by the superior court. The <br /> decision of the Board on the request for a stay shall be transmitted to the <br /> 18 Building Inspector. <br /> 19 <br /> is hereby amended to read thereafter as follows: <br /> 20 <br /> 21 K. Stay. <br /> 22 A request for any variance to the Board stays all proceedings, in <br /> furtherance of the action from which the request for a variance was <br /> 23 taken, unless the Mayor certifies to the Board, after the notice of a <br /> request for a variance shall have been filed with him, that by reason of <br /> 24 facts stated in the certification, a stay would, in his or her opinion, cause <br /> imminent peril to life or property, in which case such action shall not be <br /> 25 stayed otherwise than by a restraining order which may be issued by the <br /> Superior Court.
