• <br /> • <br /> 1 3. Adult Bookstore is a retail establishment in which: <br /> 2 a. Ten percent or more of the "stock in trade" consists of <br /> 3 books, magazines, posters, pictures, periodicals or other <br /> printed material distinguished or characterized by an em- <br /> 4 phasis on matter depicting, describing or relating to "speci- <br /> fied sexual activities" or "special anatomical areas"; or <br /> 5 b. Any person is excluded by virtue of age from all or part of <br /> 6 the premises generally held open to the public where such <br /> material is displayed or sold. <br /> 7 "Stock in trade" for the purposes of this section shall mean all <br /> 8 books, magazines, posters, pictures, periodicals, or other printed <br /> material readily available for purchase, rental, viewing or use by <br /> 9 patrons of the establishment excluding material located in any <br /> storeroom or other portion of the premises not regularly open to <br /> 10 patrons. <br /> 11 4. Adult Cabaret is a commercial establishment which presents go-go <br /> dancers, strippers, male or female impersonators, or similar enter- <br /> 12 tainers and which excludes any person by virtue of age from all or <br /> any portion of the premises. <br /> 13 5. Adult Drive-In Theater is a drive-in theater used for presenting <br /> 14 motion picture films, video cassettes, cable television, or any other <br /> such visual media, distinguished or characterized by an emphasis on <br /> 15 matter depicting, describing or relating to "specified sexual <br /> activities" or "specified anatomical areas." <br /> 16 6. Adult Entertainment Facilities mean Adult Motion Picture <br /> 17 Theaters, Adult Drive-In Theaters, Adult Bookstores, Adult <br /> Cabarets, Adult Video Stores, Adult Retail Stores, Adult Massage <br /> 18 Parlors, Adult Sauna Parlors, Adult Bath Houses, Adult Artist-Body <br /> Painting Studios, Modeling Studios and Tattoo Studios. <br /> 19 7. Adult Massage Parlor includes these commercial establishments in <br /> 20 which massage of the human body is provided for a fee excluding <br /> those individuals and facilities exempted pursuant to EMC 5.96.020 <br /> 21 and state licensed medical clinics. <br /> 22 8. Modeling Studio is an establishment or business which provides the <br /> services of modeling for the purpose of reproducing the human <br /> 23 body wholly or partially in the nude by means of photography, <br /> painting, sketching, drawing or otherwise. <br /> 24 9. Adult Motion Picture Theater is an enclosed building used for <br /> 25 presenting, for commercial purposes, motion picture films, video <br /> cassettes, cable television, or any other such visual media, <br /> 26 distinguished or characterized by an emphasis on matter depicting, <br /> describing or relating to "specified sexual activities" or "specificed <br /> 27 anatomical areas" for observation by patrons therein. <br /> 28 10. Adult Retail Store is a retail establishment in which: <br /> 29 a. Ten percent of the "stock in trade" consists of items, <br /> products or equipment distinguished or characterized by an <br /> 30 emphasis or simulation of "specified sexual activities" or <br /> "specified anatomical areas"; or <br /> 31 <br /> 32 <br /> -3- <br />
