NONCONFORMING USES. 2 The nonconforming use provisions set forth in Ordinance No. 659-80 (EMC 19.56) shall not apply to adult entertainment 3 facilities. 4 Rather, adult entertainment facilities which as a direct result of the adoption of this ordinance constitute nonconforming uses in the 5 zone in which located, may continue to operate during this interim period provided they meet the requirements of all other ordinances 6 and statutes and do not expand. However, all other adult entertainment facilities must comply with the requirements of this 7 ordinance. " 8 Section 3: That Ordinance No. 499-78 is hereby amended by the addition of 9 the following new section entitled: "Prohibited Uses" which shall read as follows: 10 A. Adult entertainment facilities 11 Section 4: That Subsection D of Section 15 of Ordinance No. 3572 which reads 12 as follows: 13 14 "Prohibited uses. 15 A. Dwelling units, except for watchman or caretaker; B. Hotels, motels; 16 C. Hospitals; D. Schools; 17 E. Playgrounds; F. Rooming, boarding and lodging houses; 18 G. Sanitariums, rest homes and homes for the aged." 19 be and the same is hereby amended to read hereafter as follows: 20 21 "Prohibited uses. 22 A. Adult entertainment facilities." 27 Section 5: That this ordinance will be in effect until December 31, 1984, 28 unless extended by the Everett City Council or earlier terminated. The Mayor is hereby 29 authorized to take all steps necessary, including legal action, to enforce this interim 30 ordinance. 31 32 -7-
