• <br /> • <br /> 1 <br /> 2. The pole sign cannot exceed twenty feet (20') in <br /> 2 height. The sign may be single face or double face, <br /> but no one sign structure shall contain more than two <br /> 3 (2) sides or panels and the total area of any one side <br /> or facing shall not exceed an area of fifty (50) square <br /> 4 feet. <br /> 5 3. The pole sign cannot be annimated nor moving in <br /> character. <br /> 6 <br /> c. Wall Sign: <br /> 7 <br /> 1. The wall sign shall be an identification sign as <br /> 8 defined herein. <br /> 9 2. The total square footage of the wall sign cannot <br /> exceed a figure obtained by doubling the lineal <br /> 10 frontage of the subject structure. (Example: lineal <br /> frontage of structure = 20 feet; a maximum <br /> 11 permitted square footage for sign = 40 square feet.) <br /> In no event shall the size of the sign exceed an area <br /> 12 of fifty (50) square feet. <br /> 13 d. Illumination: <br /> 14 1. The illumination of the surface of a sign or facade of <br /> any building shall be achieved by backlighting only <br /> 15 and not by the use of exposed bulbs. <br /> 16 2. No blinking or flashing light or strobe light or group <br /> of lights shall be allowed as part of a sign. <br /> 17 <br /> e. Exterior Display: <br /> 18 <br /> 1. No Adult Entertainment Facility shall be conducted <br /> 19 in any manner that permits the observation of any <br /> material depicting, describing or relating to <br /> 20 "Specified Sexual Activities" or "Specified <br /> Anatomical Areas," from any public way. This <br /> 21 provision shall apply to any display, decoration, sign, <br /> show window or other opening. <br /> 22 <br /> 3. No variance shall be granted from the requirements set forth in <br /> 23 Section 2(B). <br /> 24 C. ENFORCEMENT. <br /> 25 1. Violation of any of the provisions of this section entitled "Adult <br /> 26 Entertainment Facilities" is declared to be a public nuisance per <br /> se, which shall be abated by City Attorney by way of civil <br /> 27 abatement procedures only, and not by criminal prosecution. <br /> 28 2. Nothing in this section is intended to authorize, legalize or permit <br /> the establishment, operation or maintenance of any business, <br /> 29 building or use which violates any City of Everett ordinance or <br /> statute of the State of Washington regarding public nuisances, <br /> 30 sexual conduct, lewdness, or obscene or harmful matter or the <br /> exhibition or public display thereof. <br /> 31 <br /> 32 <br /> -6- <br />
