• <br /> ORDINANCE NO. 1022-84 <br /> AN ORDINANCE entitled "General Utility Taxes" providing <br /> for the imposition of an excise tax on the telegraph, <br /> telephone, electrical and natural gas businesses, levying a tax <br /> upon the gross revenues of such utility business, providing <br /> when said tax shall be paid, and establishing an effective date <br /> for the imposition of such tax upon the described utility <br /> business . <br /> WHEREAS, the City of Everett, in the exercise of its tax <br /> powers deems it necessary and advisable to impose a tax upon <br /> certain business activities in the City of Everett. <br /> NOW, THEREFORE THE CITY OF EVERETT DOES ORDAIN: <br /> Section 1 : Businesses subject to Utility Taxes. There is <br /> hereby levied and shall be collected an excise tax on account <br /> of the business activities described herein, and in the amounts <br /> to be determined by the application of the rates against gross <br /> income, as follows : <br /> A. Upon every person engaged in or carrying on a telegraph <br /> business a tax equal to four percent ( 4 % ) of the total gross <br /> income from such business in the City of Everett during the <br /> fiscal year next preceding the tax year , whichever is greater . <br /> This tax shall be paid annually, on or before the 15th day of <br /> February of each year . <br /> B. Upon every person engaged in or carrying on a telephone <br /> business, a tax equal to four percent ( 4 % ) of the total gross <br /> operating revenues, including revenues from intrastate tolls, <br /> derived from the operation of such business within the City of <br /> Everett, which shall be paid monthly on or before the 20th day <br /> of the following month. <br /> ( 1 ) Gross operating revenues for this purpose shall <br /> not include charges which are passed on the the subscribers <br /> by a telephone company pursuant to tariffs required by <br /> regulatory order to compensate for the cost to the company <br /> of the tax imposed by this ordinance. <br /> ( 2 ) "Telephone business" means the business of <br /> providing access to a local telephone network , local <br /> telephone network switching service, toll service, or coin <br /> telephone services, or providing telephonic, video, data, <br /> or similar communication or transmission for hire, via a <br /> local telephone network , toll line or channel , or similar <br /> communication or transmission system. It includes <br /> cooperative or farmer line telephone companies or <br /> associations operating an exchange. "Telephone business" <br /> does not include the providing of competitive telephone <br /> services , nor the providing of cable television services. <br />
