Rezone File #9-83 K S H Printers • THIS AGREEMENT made and entered this „,?„ 71e1 day of /Marc h , 1984, by and between the City of Everett, a municipal corporation under the laws of the State of Washington, hereinafter called "City," and Vernon Haines and Norma R. Haines, hereinafter called "Owner." 1 • WITNESSETH WHEREAS, the Owner has made application to the City to establish d zoning on the parcel of property described in the Ordinance which is • ! marked Exhibit "A," attached hereto and incorporated herein by reference; • and WHEREAS, the Owner's proposed zoning and development would create a situation where a C-1, General Commercial Zone would abut a Single-Family Suburban Residential Zone; and WHEREAS, it is believed that the zoning of said area to permit fl Owner's development will be in the public health, safety and welfare of d the citizens of Everett and, further, that the public health, safety, and ii welfare of the citizens of Everett would best be served by anticipating !i the impact of such development and imposing certain mutually agreed upon standards, conditions and requirements; and WHEREAS, the Owner has agreed to develop the aforementioned ! property per the site plan which is marked Exhibit "B", attached hereto !, and incorporated herein by reference in consideration of the City j considering designating the property C-1 and the Owner further agrees as part of said consideration that should the City zone the property C-1, to i• lay out, develop and maintain the property as hereinafter set forth; • 11 li li -1-
