NOW, THEREFORE, it is mutually agreed as follows: <br /> Section 1: LIMITED USE. That the applicant shall conform to the <br /> site plan submitted on December 6, 1983 (Exhibit "B") . Any modifications <br /> determined as substantial by the Planning Director shall activate <br /> additional hearings by the City's Hearing Examiner to amend the site plan <br /> and this concomitant agreement. <br /> Section 2: LANDSCAPING. That landscaping shall be provided around <br /> the entire perimeter of the subject property. A specific landscaping plan <br /> shall be submitted to the Public Works Department and approved by the <br /> Public Works Department prior to issuance of any building permits. The <br /> landscape treatment of the southern edge (adjacent to the 104th Street <br /> right-of-way) and the easterly edge shall be five (5) feet in width, and <br /> designed to create a sight obscuring barrier' in five (5) years time. <br /> Section 3: BUILDING HEIGHT. That the height of the southern <br /> building be limited to 35 feet in order to be compatible with adjacent <br /> residential uses. <br /> Section 4: FENCING. That the applicant shall construct a 6-foot <br /> high solid wooden fence on the southern edge , of the parking lot. The <br /> final site plan shall be modified to reflect this improvement. <br /> Section 5: PUBLIC WORKS REQUIREMENTS. <br /> A. Detailed drawings, in accordance with City Design and <br /> Construction Standards, shall be submitted to the Public <br /> Works Department showing site parking layout, landscaping, <br /> utilities, storm drainage, temporary construction erosion <br /> control, and all required improvements in the public <br /> right-of-way. Public Works Department approval of these <br /> drawings is required prior to any permits being issued. All <br /> improvements shall be completed, approved, and warranted <br /> before the Occupancy Permit is issued. <br /> B. Dedication of right-of-way on 4th Avenue West of 10 feet is <br /> required; this dedication must radius onto Everett Mall Way. <br /> Dedication of 30 feet of right-of-way on 104th Street SW is <br /> required. Local Improvement District Covenant is required <br /> for 104th St. S.W. <br /> -2- <br />
