b. A"Stop Work" order was issued and posted on February 18, 2009 at the <br /> residence located at 420 47th St SE. A re-inspection on April 14, 2009 reveals <br /> the placard has been removed. This is a violation of EMC16.01.040 (Q) <br /> R114.3. <br /> c. The addition to the single-family residence, as constructed does not meet <br /> minimum rear setback requirements as outlined in Table 6.1 of the Everett <br /> Land Use Code, and has not been certified as non-conforming. This is a <br /> violation of EMC 19.39.150 (C) <br /> 4. Corrective Action, Deadline <br /> The respondent must complete the following corrective actions to eliminate the <br /> above listed conditions: <br /> a. Stop work on the addition to the single-family residence immediately, <br /> obtain the necessary permits to continue work, and take actions necessary <br /> to bring the residence into compliance with the issued permits. <br /> b. Contact the City of Everett Building Division at (425) 257-8810 for building <br /> permit information no later than May 8, 2009. <br /> c. If seeking a land use decision for non-conforming setback, a non- <br /> conforming use application is required to be submitted to the City <br /> Planning Department by May 8, 2009. <br /> 5. Hearing Date, Time & Location <br /> Respondent is scheduled to appear before the Violations Hearing Examiner on: <br /> HEARING DATE: Thursday, May 21, 2009 at 9:00am. <br /> LOCATION: City of Everett Violations Hearing Room <br /> Wall Street Building, Suite #8-C <br /> 2930 Wetmore Avenue <br /> Everett, Washington 98201 <br /> 6. Agreed Order <br /> If the respondent is not a Repeat Violator (see Paragraph 1) and has completed <br /> the minimum corrective action described in this citation, he/she is eligible to <br /> enter into an agreed order with the city. The agreed order means that the city <br /> agrees that it will not take further action against the respondent regarding the <br /> violations described in this citation as long as there are no further nuisance- <br /> related EMC violations for the two-year period following the date of the order. <br /> If the Respondent is eligible to enter into and agreed order with the city and <br /> signs the agreed order, the Respondent is no longer required to appear at the <br /> hearing set forth in Paragraph EXIIMIT <br /> Everett Police Department,Code Enforcement Unit•3002 Wetmore Ave•Everett,WA 98201 •425-257-8560 25 <br />
