3. Violations & EMC Sections <br /> Inspection of the property reveals the following conditions and violations: <br /> Conditions observed on the property constitute violations of the following provisions <br /> of the International Residential Code (the"IRC"), as adopted by EMC 16.01, <br /> the Everett Building Code and the Everett Zoning Code: <br /> IRC R113.1, Unlawful acts, which states; <br /> It shall be unlawful for any person, firm or corporation to erect, construct, alter, <br /> extend, repair, move, remove, demolish or occupy any building, structure or <br /> equipment regulated by this code, or cause the same to be done, in conflict with or <br /> in violation of any of the provisions of this code. <br /> IRC R105.1 Permit Required,which states; <br /> Any owner or authorized agent who intends to construct, enlarge, alter, repair, <br /> move, demolish or change the occupancy of a building or structure, or to erect, <br /> install, enlarge, alter, repair, remove, convert or replace any electrical, gas, <br /> mechanical or plumbing system, the installation of which is regulated by this code, <br /> or cause any such work to be done, shall first make application to the building <br /> official and obtain the required permit. <br /> EMC 19.06, Table 6.1 Development Standards, which requires a 20-foot rear <br /> setback in the R-1 zone. <br /> EMC 19.39.150.C, Required setbacks-Exceptions, which states; <br /> No improvement or structure may be located in a required setback area. <br /> The following specific violations were observed during various inspections of the <br /> property between December 2008 and May 2009. <br /> a. Addition to a single-family residence is being done without benefit of permit. <br /> This is a violation of the International Residential Code 113.1 as <br /> adopted by EMC 16.01 <br /> b. The addition to the single-family residence, as constructed does not meet <br /> minimum rear setback requirements as outlined in Table 6.1 of the Everett <br /> Land Use Code, and has not been certified as non-conforming. This is a <br /> violation of EMC 19.39.150 (C) <br /> 4. Corrective Action, Deadlines <br /> The respondent applied on May 8, 2009 for a nonconforming building <br /> certification for a ten-foot rear setback (NCU09-002). The Planning Director <br /> decision denied granting a nonconforming setback for the addition on May 22, <br /> 2009. The respondent must take the following corrective actions: <br /> EXHIBIT <br /> 0.73C <br />
