1. The respondent must comply with the Land Use Code's 20-foot rear <br /> setback requirement by July 20, 2009. To meet this requirement, the <br /> following is an incomplete list of possible corrective actions that the <br /> respondent may pursue: <br /> a. Reduce the height of the building within the 20-foot rear setback <br /> and covert the space to accessory use only. <br /> b. Obtain a variance from the Hearing Examiner to reduce the 20-foot <br /> rear setback to ten feet. <br /> c. Obtain a ten-foot wide strip along the respondent's west lot line <br /> from the adjacent property through a Boundary Line Adjustment <br /> (BLA). <br /> d. Obtain approval from the Planning Director through Review Process <br /> II and convert the living space to accessory space and lower the <br /> height of the building to 20 feet within the 20-foot rear setback. <br /> 2. If the respondent is able to comply with the Land Use Code, the following <br /> must be completed: <br /> a. The respondent must submit a complete building permit application by <br /> July 20, 2009. <br /> b. The respondent must obtain a Certificate of Occupancy by December <br /> 18, 2009. <br /> 3. If the respondent is unable to comply with the with the Land Use <br /> Code and or building codes, the respondent must demolish the portion of <br /> the building that was built without permits and have a City Inspector <br /> conduct an inspection no later than July 20, 2009. A demolition permit is <br /> required prior to demolition. <br /> 5.
