6. Agreed Order <br /> If the respondent is not a Repeat Violator (see Paragraph 1) and has completed <br /> the minimum corrective action described in this citation, he/she is eligible to <br /> enter into an agreed order with the city. The agreed order means that the city <br /> agrees that it will not take further action against the respondent regarding the <br /> violations described in this citation as long as there are no further nuisance- <br /> related EMC violations for the two-year period following the date of the order. <br /> If the Respondent is eligible to enter into and agreed order with the city and <br /> signs the agreed order, the Respondent is no longer required to appear at the <br /> hearing set forth in Paragraph 5. <br /> 7. Hearing examiner <br /> Following the hearing, the Violations Hearing Examiner may issue an order <br /> against the Respondent, even if he/she does not attend the hearing. The <br /> Hearing Examiners' Order may include any/all of the following conditions: <br /> A. A requirement that all of the violations be corrected and to set a deadline <br /> for these corrections; <br /> B. A fine of up to $500.00 per violation for initial violators; <br /> C. A fine of up to $1,000.00 per violation for repeat violators; <br /> D. Additional costs incurred by the city; <br /> E. Authorization for the city to enter the property, correct the violations and <br /> to assess the costs of the corrections, as permitted by law; <br /> F. The Hearing Examiner may maintain jurisdiction of this matter for up to <br /> two years from the date of the order. <br /> VIOLATION OF A HEARING EXAMINERS ORDER IS A CRIMINAL OFFENSE <br /> NOTHING HEREIN RELIEVES RESPONDENTS FROM THEIR OBLIGATION TO <br /> COMPLY WITH ALL APPLICABLE CODES] <br /> 8.
