FINDINGS <br /> 1. Respondent, Steve M.Hale,is the owner of record of the property located at 420 <br /> 47th St SE,Everett,Washington. (Exhibit#8—Record of Snohomish County <br /> Assessor.) The property is located in an R-1 Single Family Detached Low <br /> Density Residential Zone. (Exhibit#7—Metroscan Property Profile.) <br /> 2. On December 5,2008 a complaint was received by the City Building Division <br /> concerning an addition that was being constructed without permits and a leaning <br /> retaining wall. <br /> 3. On December 8, 2008, Chief Building Inspector Ted Budden inspected the <br /> property and observed a two story addition to a single-family residence that was <br /> being constructed without the required permits from the City of Everett. An <br /> Inspection Report that listed observed violations of the Everett Municipal Code <br /> ("EMC")was generated. The Inspection Report required the Respondent to"Stop <br /> Work" and obtain required permits. A copy of the report was posted on-site. <br /> (Exhibit#1e-Inspection Report dated December 8, 2008). <br /> 4. On December 16, 2008 and February 17, 2009, the Respondent went to the City <br /> Permit Counter to speak with representatives from the Building and Planning <br /> Departments to discuss what was required to bring the property into compliance <br /> with EMC. The Planning Department explained the development standards for the <br /> property and that it would not accept a building permit application for the <br /> structure if the proposal was in violation of development standards, including <br /> setback requirements. <br /> 5. On February 18, 2009, the City Building Department received information that <br /> construction activities continued. On that date Chief Building Inspector Ted <br /> Budden inspected the property and posted a "Stop Work" Order. (Exhibit 4.1c- <br /> Inspection <br /> 1c- <br /> Inspection Report dated February 18, 2009 and Exhibit #1 d - photograph of <br /> posting). <br /> 6. On February 23, 2009 the Respondent presented a site plan to Teresa Firnstahl <br /> City Planning Department that called for a distance of 10.5-feet from the single- <br /> family residence on site to the rear property lot line. She told the Respondent <br /> that,according to the site plan,the single-family residence would not meet the 20- <br /> foot rear setback requirement under EMC §19.06.010, Development Standards <br /> Table 6.1: <br /> The "'rear setback 'is the required minimum distance between the rear lot <br /> line and any structure, building or use. " EMC§19.04.020. <br /> The Respondent requested a non-conforming use application to certify living <br /> space had existed prior to the construction of the addition in the 20-foot rear <br /> setback. <br /> �� <br />
