7. On April 14, 2009, Chief Building Inspector Budden revisited the site and <br /> observed that the "Stop Work" Order posted on February 18, 2009 had been <br /> removed by someone other than the Building Division. Photographs were taken <br /> and Inspection Report generated to document the findings. (Exhibit #1 a — 1 b — <br /> Inspection Report dated Apri114, 2009 and photograph by Inspector Budden). <br /> 8. On May 1, 2009, a Violation Citation was issued to the Respondent. The <br /> Respondent was notified via certified return receipt and first class mail that <br /> conditions on the property violated provisions of the International Residential <br /> Code ("IRC") as adopted by EMC §16.01 and the Everett Zoning Code. (Exhibit <br /> #2- Violation Citation dated May 1, 2009). <br /> 9. The Violation Citation notified the Respondent that he had removed a "Stop <br /> Work" order posted on the property. It required him to "Stop Work" on the <br /> addition to the single-family residence and obtain the necessary permits to <br /> continue the work, and to take actions necessary to bring the residence into <br /> compliance with the issued permits. <br /> 10. The Violation Citation further required that if the Respondent intended to seek a <br /> land use decision for non-conforming setback, a non-conforming use application <br /> was required to be submitted to the City Planning Department by May 8,2009. <br /> 11. On May 8, 2009, the Respondent made application for non-conforming use <br /> certification to the City Planning Department. On May 22, 2009 a letter of denial <br /> on the non-conforming use was issued by Gerry Ervine, Land Use Manager. The <br /> Respondent's request to certify a portion of the former building located in the 20 <br /> foot setback as living space was denied. (Exhibit #3 - Letter from Gerry Ervine <br /> Land Use Manager dated May 22, 2009). The Respondent did not appeal the <br /> Land Use Manager's decision. <br /> 12. On June 26,2009,a second Violation Citation was issued to the Respondent. The <br /> Respondent was notified via certified return receipt and first class mail that <br /> conditions on the property remained in violation of IRC and the Everett Zoning <br /> Code. (Exhibit#4- Violation Citation dated June 26, 2009). Code Enforcement <br /> Officer Spring Wathen hand delivered the Violation Citation to the Respondent, <br /> Steve M. Hale, at the property located at 420 47th St SE. <br /> (Exhibit#5 -Declaration of Service dated June 26, 2009). <br /> 13. On July 20,2009,the Respondent made an application to the City Planning <br /> Department for a Boundary Line Adjustment. This application was determined <br /> incomplete on July 28, 2009. (Exhibit#10-Determination of Incomplete <br /> Application dated July 28, 2009.) <br /> 14. No corrections as required by the Violation Citation were done and the matter <br /> was presented to the Violations Examiner by Code Officer Wathen on July 30, <br /> d`3 <br />
