The activities of the Respondent, described above are alterations as defined IRC <br /> R105.1 and require a building permit. <br /> 3. Portions of the addition are on the structure onsitewithin required rear setback <br /> and in violation of EMC §19.39.150(C)The Ordinance reads; <br /> "No improvement or structure may be located in a required setback <br /> area." The "'rear setback'means the required minimum distance between <br /> the rear lot line and any structure, building or use." EMC§19.04.020. <br /> 4. By removing the"Stop Work"order posted by Inspector Budden,the Respondent <br /> violated IRC 114.3 as enacted by Chapter 16.01 EMC,which states, <br /> "It shall be unlawful for any person to remove or deface any placard <br /> applied pursuant to this section until the required repairs, demolition or <br /> removal have been completed and a certfficate of occupancy is issued <br /> pursuant to the provisions of this code. " <br /> 5. Pursuant to EMC § 1.20.020(A)(19) and EMC § 16.01.040(0),the Violations <br /> Hearing Examiner has jurisdiction over the issues and parties. <br /> ORDER <br /> Based on the Findings of Fact and Conclusions of Law read into the record at the March <br /> 11,2010,hearing of the above matter,the following Order is issued: <br /> 1. Steve M. Hale shall abate all violations of IRC 105.1; IRC 113.1 and EMC <br /> §19.39.150(C)on the property located at 420 47th Street SE, Everett,Washington. <br /> 2. The Respondent must comply with the Everett Land Use Code. <br /> 3. The Respondent must obtain any construction permits required pursuant to EMC <br /> Title 16. <br /> 4. All necessary construction work referenced in the above mentioned permits must <br /> be completed,inspected and approved by the City and a Certificate of Occupancy <br /> obtained. <br /> 5. If the Respondent does not comply with this Order,that portion of the building <br /> that was built without permits must be demolished at the order of the City. A <br /> demolition permit is required prior to demolition. <br /> 6i . <br />
