Wright Jr. <br /> 2320 Rucker <br /> Everett, WA 98201 <br /> Dear Property Owner: <br /> Failure to comply with the conditions listed in this notice may result in a <br /> hearing before the City's Hearings Examiner and a fine and /or costs being <br /> assessed against you. <br /> Upon a recent inspection of your property located at 812 35th Street, the following <br /> violations of the Everett Municipal Code existed: <br /> An inspection on January 15, 2016 revealed accumulations of yard waste, tree clippings <br /> and debris has been placed at the top of the slope and extends into the ravine across <br /> from the tennis courts and in the rear yard adjacent to the slope. Used lumber, window <br /> screens and other salvage materials were noted in the pile. A search of critical area <br /> maps and review by the Everett Planning staff revealed that the slope and ravine meet <br /> the criteria for erosion and landslide hazards. This property has slopes and is mapped <br /> as a Landslide and Erosion Hazard Area with medium slopes ranging between 25% — <br /> 40% per City of Everett Landslide and Erosion Maps. Medium slopes are classified as <br /> critical areas. Per EMC 19.37.010, no action may be undertaken by any person which <br /> results in any alteration of a critical area or its buffer. This includes any modification of <br /> the natural environment including any clearing, grading, filling and/or excavation <br /> without obtaining City approval. Yard waste and other debris material has been placed <br /> on the slope for many years and the City has concerns over the stability of the slope. <br /> The current conditions are in violation of the following sections of the Everett Municipal <br /> Code: <br /> EMC 8.20.020 provides that no person owning, leasing, renting, occupying or having <br /> charge or possession of any property in the city, including vacant lots, shall maintain or <br /> allow to be maintained on the property outside of a fully enclosed structure such <br /> as a shed, dwelling, or closeable garage, any of the following conditions visible <br /> from any street, alley, or other public or private property: <br /> (A)Junk, trash, litter, boxes, discarded lumber, salvage materials or other similar <br /> materials in any front yard, side yard, rear yard or vacant lot. <br /> Everett Police Department, Code Enforcement Unit•3002 Wetmore Ave•Everett,WA 98201 •425-257-8560 <br />
