regulations, and relevant orders of the Secretary of Labor; that it will furnish the City, HUD, <br /> and the Secretary of Labor such information as they may require for the supervision of <br /> such compliance; and that it will otherwise assist the City, HUD, and the Department of <br /> Labor in the discharge of the Department of Labor's primary responsibility for securing <br /> compliance. The Agency will also ensure the compliance of contractors and <br /> subcontractors with state requirements pertaining to equal opportunity. <br /> J. Non-Discrimination <br /> It is the policy of the City to reject discrimination which denies equal treatment to any <br /> individual because of his or her race, creed, color, national origin, families with children, <br /> marital status, sexual orientation, age, honorably discharged veteran or military status, or <br /> the presence of any sensory, mental, or physical disability or the use of a trained dog <br /> guide or service animal by a person with a disability as provided in Washington's Law <br /> against Discrimination, Chapter 49.60 RCW, and the Snohomish County Human Rights <br /> Ordinance, Chapter 2.460 SCC. These laws protect against specific forms of <br /> discrimination in employment, credit transactions, public accommodation, housing, county <br /> facilities and services, and county contracts. <br /> The Agency shall comply with Chapter 2.460 SCC, which is incorporated herein by this <br /> reference. Execution of this Loan Agreement constitutes a certification by the Agency of <br /> the Agency's compliance with the requirements of Chapter 2.460 SCC. If the Agency is <br /> found to have violated this provision, or to have furnished false or misleading information <br /> in an investigation or proceeding conducted pursuant to Chapter 2.460 SCC, this Loan <br /> Agreement may be subject to a declaration of default and termination at the City's <br /> discretion. This provision shall not affect the Agency's obligations under other federal, <br /> state, or local laws against discrimination. <br /> K. Environmental Review <br /> 1. NEPA <br /> Pursuant to 24 CFR § 92.352(b)(1), the City retains responsibility for environmental <br /> review, decision making and action for purposes of fulfilling requirements of the <br /> National Environmental Policy Act ("NEPA") for each activity carried out with HOME <br /> funds. The City may require the Agency to furnish data, information, and assistance <br /> for its review and assessment in order for the City to discharge its responsibilities, <br /> including determining whether the City must prepare an Environmental Impact <br /> Statement. <br /> 2. SEPA <br /> The Agency retains responsibility for fulfilling the requirements of the State <br /> Environmental Policy Act ("SEPA") and regulations and ordinances adopted <br /> thereunder. <br /> 3. Compliance as a Pre-Condition <br /> Performance by the Agency under this Loan Agreement shall include satisfaction of <br /> all applicable requirements of the National and State Environmental Policy Acts.
