• <br /> 1 of issuance of the Notice of Parking Violation, the City shall mail by first class mail a <br /> 2 Delinquency Notice to the registered owner of the vehicle to which the notice was <br /> 3 affixed, informing him/her of the violation and of a right to request a hearing. <br /> 4 B. If no request for a hearing or payment be made within ten (10) calendar <br /> 5 days of the date of mailing the Delinquency Notice, the registered owner of the vehicle <br /> 6 is hereby declared delinquent and the City may bring suit for judgment on the penalities <br /> 7 plus costs of suit. The City may also turn this matter over to a collection agency. <br /> 8 Section 28: Hearing to Contest Validity of Notices. <br /> 9 A. Any individual receiving a Notice of Parking Violation or a Delinquency <br /> 10 Notice may contest the notices issued by requesting a hearing thereon with the City <br /> 11 Treasurer. <br /> 12 B. Upon receipt of a timely request for a hearing as is identified in Section <br /> 13 27 herein, the City Treasurer or designee shall set the matter for hearing on the <br /> 14 Parking Hearing Examiner's calendar. <br /> 15 C. The Hearing Examiner may, in its discretion, affirm, nullify or modify the <br /> 16 Notice of Parking Violation. In addition, the Hearing Examiner may, in its discretion, <br /> 17 modify, waive, reduce or suspend the monetary penalty prescribed for the violation. <br /> 18 Section 29: Declaration of a Nuisance. <br /> 19 Any vehicle which is found in violation of the provisions of this Ordinance and/or <br /> 20 any other parking ordinance of the City, on three separate occasions within a twelve <br /> 21 month period, shall constitute a public nuisance in that said vehicle has repeatedly <br /> 22 inhibited the orderly movement of vehicles into parking spaces on the streets of the <br /> 23 City, created an obstruction to traffic, and restricted public access to limited parking <br /> 24 spaces in the City and created a disincentive to others to obey the City's parking <br /> 25 ordinances. <br /> 26 Section 30: Notification of Hearing for Declaration of Vehicle as Nuisance. <br /> 27 Whenever any vehicle shall have been cited for three violations of this Ordinance <br /> 28 and/or any other parking ordinance of the City, within a twelve month period, each of <br /> 29 which remains unpaid ten days after the issuance of the Notice of Parking Violation, the <br /> 30 City shall send to the registered and legal owners of said vehicle as shown by the <br /> 31 <br /> 32 -19- <br />
