• <br /> • <br /> 1 records of the State of Washington Department of Licenses a notification of hearing on <br /> 2 the issue of whether said vehicle constitutes a public nuisance as defined in Section 29. <br /> 3 Notification of hearing on the issue of whether said vehicle constitutes a public <br /> 4 nuisance shall be sent by registered mail or by certified mail with return receipt <br /> 5 requested. Said notification shall include the following information: <br /> 6 A. The license number of the vehicle. <br /> 7 B. The name of the registered owner of the vehicle as shown by the records <br /> 8 of the Washington State Department of Licenses. <br /> 9 C. The date and nature of each violation which will form the basis the <br /> 10 declaration of the vehicle as a nuisance. <br /> 11 D. A statement that the vehicle will be declared a nuisance unless: <br /> 12 <br /> 1. All outstanding, unpaid penalties for violation of the Parking <br /> 13 Ordinance of the City are paid within 10 calendar days of the date <br /> of mailing of the notification; or <br /> 14 <br /> 2. A request for hearing is filed within 10 calendar days of the date of <br /> 15 mailing with the City Treasurer or his designee. <br /> 16 <br /> E. A statement that if the vehicle is declared a nuisance it will be subject to <br /> 17 <br /> immobilzation pursuant to this Ordinance. <br /> 18 <br /> F. The address and telephone number where additional information may be <br /> 19 <br /> obtained. <br /> 20 <br /> Section 31: Hearing on Declaration of Vehicles as Nuisance. <br /> 21 <br /> A. Upon receipt of a timely request for hearing, the City Treasurer or his <br /> 22 <br /> designee shall promptly set a hearing. The hearing shall be conducted in accordance <br /> 23 <br /> with such procedures as the Parking Hearing Examiner shall establish. The parties shall <br /> 24 <br /> be notified promptly of the result. <br /> 25 <br /> B. The Hearing Examiner shall enter a finding of nuisance only upon making <br /> 26 <br /> the following determinations: <br /> 27 <br /> 28 1. The identity of the registered owner of the vehicle as shown by the <br /> records of the Washington State Department of Licenses. <br /> 29 <br /> 2. The identity of the cited vehicle including the license number of <br /> 30 said vehicle. <br /> 31 <br /> 32 -20- <br />
