• • 1 records of the State of Washington Department of Licenses a notification of hearing on 2 the issue of whether said vehicle constitutes a public nuisance as defined in Section 29. 3 Notification of hearing on the issue of whether said vehicle constitutes a public 4 nuisance shall be sent by registered mail or by certified mail with return receipt 5 requested. Said notification shall include the following information: 6 A. The license number of the vehicle. 7 B. The name of the registered owner of the vehicle as shown by the records 8 of the Washington State Department of Licenses. 9 C. The date and nature of each violation which will form the basis the 10 declaration of the vehicle as a nuisance. 11 D. A statement that the vehicle will be declared a nuisance unless: 12 1. All outstanding, unpaid penalties for violation of the Parking 13 Ordinance of the City are paid within 10 calendar days of the date of mailing of the notification; or 14 2. A request for hearing is filed within 10 calendar days of the date of 15 mailing with the City Treasurer or his designee. 16 E. A statement that if the vehicle is declared a nuisance it will be subject to 17 immobilzation pursuant to this Ordinance. 18 F. The address and telephone number where additional information may be 19 obtained. 20 Section 31: Hearing on Declaration of Vehicles as Nuisance. 21 A. Upon receipt of a timely request for hearing, the City Treasurer or his 22 designee shall promptly set a hearing. The hearing shall be conducted in accordance 23 with such procedures as the Parking Hearing Examiner shall establish. The parties shall 24 be notified promptly of the result. 25 B. The Hearing Examiner shall enter a finding of nuisance only upon making 26 the following determinations: 27 28 1. The identity of the registered owner of the vehicle as shown by the records of the Washington State Department of Licenses. 29 2. The identity of the cited vehicle including the license number of 30 said vehicle. 31 32 -20-
